Nul ne peut nier que la qu\u00eate de flexibilit\u00e9 affich\u00e9e par la plateforme correspond \u00e0 un certain air du temps. Mais \u00e0 force de flirter avec les limites de ce qui est autoris\u00e9, le risque de rupture devient de plus en plus concret. Ainsi, Actiris vient de &lsquo;bloquer&rsquo; les offres d&#8217;emploi de la plateforme en attente d&rsquo;un positionnement clair des autorit\u00e9s quant \u00e0 la nature de la relation de travail propos\u00e9e.<!--more--><\/p>\n<p>Deliveroo annonce en effet une forte augmentation du nombre de coursiers qui choisissent de travailler de mani\u00e8re flexible en tant qu\u2019ind\u00e9pendant. <em>\u00ab\u00a0Cette croissance souligne la popularit\u00e9 du mod\u00e8le qui permet aux coursiers de choisir de travailler quand et o\u00f9 ils le d\u00e9sirent, et par cons\u00e9quent d\u2019obtenir une r\u00e9mun\u00e9ration plus \u00e9lev\u00e9e.\u00a0Durant la seule premi\u00e8re semaine de janvier, plus de 1000 personnes ont postul\u00e9 pour collaborer avec Deliveroo en Belgique comme ind\u00e9pendants ou \u00e9tudiants ind\u00e9pendants.\u00a0Plus de 50% des commandes de Deliveroo en Belgique sont maintenant livr\u00e9es par des coursiers ind\u00e9pendants, qui b\u00e9n\u00e9ficient de l\u2019avantage de pouvoir travailler quand et o\u00f9 ils le d\u00e9sirent.\u00a0\u00bb<\/em><\/p>\n<p>Malgr\u00e9 les mouvements sociaux intervenus pendant la tr\u00eave des confiseurs, Deliveroo a constat\u00e9 <em>\u00ab\u00a0une croissance des commandes de 3,7% par rapport au lundi 1er janvier, date o\u00f9 la demande est d\u00e9j\u00e0 habituellement \u00e9lev\u00e9e. Toujours par rapport au 1er janvier, l\u2019entreprise a \u00e9galement constat\u00e9 une augmentation du nombre de coursiers connect\u00e9s sur la plateforme de 32%.\u00a0\u00bb<\/em><\/p>\n<p>L&rsquo;enjeu social est clair : Deliveroo d\u00e9clare vouloir\u00a0conjuguer la flexibilit\u00e9 du travail avec plus de s\u00e9curit\u00e9 pour les coursiers. <em>\u00ab\u00a0C\u2019est pourquoi, depuis le 1er janvier 2018, tous les coursiers ind\u00e9pendants de Deliveroo en Belgique ont acc\u00e8s \u00e0 une assurance accidents enti\u00e8rement gratuite, qui les couvre en cas d\u2019accident survenu en travaillant avec l\u2019entreprise. Deliveroo est la premi\u00e8re plateforme de livraison de repas \u00e0 la demande \u00e0 offrir cette couverture d&rsquo;assurance. Plus loin, nous appelons<\/em>\u00a0<em>les autorit\u00e9s \u00e0 am\u00e9liorer le droit du travail pour permettre aux plateformes d\u2019offrir d\u2019autres avantages, par exemple des cong\u00e9s maladie et cong\u00e9s pay\u00e9s. Deliveroo souhaite mettre fin au compromis entre flexibilit\u00e9 et s\u00e9curit\u00e9 qui existe actuellement en droit du travail, pour l\u2019adapter au 21\u00e8me si\u00e8cle.\u00a0\u00bb<\/em> Deliveroo a constamment indiqu\u00e9 souhaiter travailler en \u00e9troite collaboration avec les repr\u00e9sentants syndicaux et la classe politique pour y parvenir.<\/p>\n<p>Le CEO de la plateforme en Belgique, Mathieu de Lophem, ajoute : <em>\u00ab\u00a0Deliveroo est \u00e0 l\u2019\u00e9coute des coursiers, c\u2019est pourquoi nous recherchons constamment \u00e0 rendre notre offre plus g\u00e9n\u00e9reuse. Nous travaillerons avec eux et les autres acteurs concern\u00e9s pour y arriver. Nous savons que les coursiers m\u00e9ritent plus de protection, raison pour laquelle nous avons appel\u00e9 \u00e0 la fin du compromis entre flexibilit\u00e9 et s\u00e9curit\u00e9 qui existe actuellement en droit du travail. Deliveroo veut offrir aux coursiers des avantages d\u2019une mani\u00e8re compatible avec la flexibilit\u00e9 du travail, dont nous savons que les coursiers ch\u00e9rissent. Cela rendrait le droit du travail adapt\u00e9 au 21\u00e8me si\u00e8cle\u00a0\u00bb.<\/em><\/p>\n<p>Pr\u00f4ner le passage au 2&amp;\u00e8me si\u00e8cle est une chose. Rassembler les \u00e9nergies autour de ce projet ambitieux en est une autre. Actiris vient de d\u00e9cider\u00a0de retirer une offre d\u2019emploi diffus\u00e9e le 12 janvier 2018 par la soci\u00e9t\u00e9 Deliveroo.<br \/>\n<em>\u00ab\u00a0Actiris met \u00e0 disposition des employeurs une plate-forme leur permettant de diffuser gratuitement des offres d\u2019emploi. Cet outil permet le recrutement de nouveaux collaborateurs sous le statut de salari\u00e9, r\u00e9gi par la loi du 3 juillet 1978 relative aux contrats de travail. Il permet \u00e9galement la recherche de travailleurs sous statut d\u2019ind\u00e9pendant, tout en respectant la r\u00e8glementation en la mati\u00e8re.\u00a0L\u2019offre de Deliveroo, publi\u00e9e dans la cat\u00e9gorie \u00ab salari\u00e9s \u00bb, laisse \u00e0 penser que les postes propos\u00e9s ne correspondent pas au statut de salari\u00e9 mais plut\u00f4t \u00e0 un statut d\u2019ind\u00e9pendant. En tant que service public d\u2019emploi, Actiris est financ\u00e9 exclusivement par de l\u2019argent public. Il vise d\u00e8s lors \u00e0 \u00ab garantir un accompagnement de qualit\u00e9 aux chercheurs\/euses d\u2019emploi dans leur transition vers un emploi durable et de qualit\u00e9, et fournir aux employeurs en recherche de collaborateurs\/trices des solutions et outils efficaces et gratuits.
