La proc\u00e9dure, elle, commencera 150 jours plus t\u00f4t, soit en d\u00e9cembre 2015. Afin que les d\u00e9partements RH puissent s\u2019y pr\u00e9parer le mieux possible, il est d\u00e9j\u00e0 temps de se rappeler les grands principes applicables!<!--more--><\/div>\n<p>L\u2019ann\u00e9e 2015 a toute son importance. En effet, c\u2019est l\u2019effectif moyen de 2015 qui permettra aux entreprises de d\u00e9terminer si elles doivent organiser ou non des \u00e9lections sociales en 2016.  Si ce nombre atteint 50 travailleurs, un comit\u00e9 pour la pr\u00e9vention et la protection au travail (CPPT) devra \u00eatre constitu\u00e9. Si l\u2019entreprise compte au moins 100 travailleurs, c\u2019est un conseil d\u2019entreprise (CE) qui devra \u00eatre mis sur pied.<\/p>\n<p>Par ailleurs, m\u00eame si l\u2019entit\u00e9 juridique ne compte pas 50 travailleurs, l\u2019entreprise est concern\u00e9e par les \u00e9lections sociales quand une unit\u00e9 technique d\u2019exploitation atteint ce plafond. La notion d\u2019UTE repose sur une coh\u00e9sion sociale ou \u00e9conomique entre diff\u00e9rentes entit\u00e9s juridiques. C\u2019est donc avant tout la r\u00e9alit\u00e9 socio-\u00e9conomique et non la forme juridique qui d\u00e9termine ce qu\u2019il faut consid\u00e9rer comme entreprise.<\/p>\n<h2>Harmonisation des statuts et \u00e9lections sociales<\/h2>\n<p>Dans le cadre de la r\u00e9glementation relative aux \u00e9lections sociales, la notion de travailleur comprend tous les travailleurs engag\u00e9s par un contrat de travail ou de formation d\u2019apprentissage. Dans cette optique, les travailleurs \u00e9tudiants sont donc, eux aussi, des travailleurs occup\u00e9s durant la p\u00e9riode de r\u00e9f\u00e9rence. <\/p>\n<p>La loi sur le statut unique a cr\u00e9\u00e9 un premier rapprochement entre les statuts des ouvriers et des employ\u00e9s en mati\u00e8re de d\u00e9lais de pr\u00e9avis et de jours de carence. N\u00e9anmoins, elle ne devrait avoir aucun impact sur les \u00e9lections sociales en 2016. Sauf modification de la loi, la repr\u00e9sentation du personnel au conseil d\u2019entreprise et au comit\u00e9 de pr\u00e9vention sera toujours bas\u00e9e sur les statuts classiques des ouvriers et employ\u00e9s. Les cadres et les jeunes de moins de 25 ans peuvent \u00e9galement obtenir des si\u00e8ges distincts. Ainsi, il devrait y avoir peu de changements en 2016 par rapport aux derni\u00e8res \u00e9lections sociales : des candidatures seront introduites pour les diff\u00e9rentes cat\u00e9gories (ouvriers, employ\u00e9s, cadres et jeunes travailleurs), les si\u00e8ges \u00e0 pourvoir au CE et au CPPT seront r\u00e9partis sur la base du poids de ces diff\u00e9rentes cat\u00e9gories au sein du personnel et les travailleurs voteront pour les candidats de leur propre cat\u00e9gorie.<\/p>\n<h2>Privil\u00e9gier les travailleurs ordinaires pour 2015 ?<\/h2>\n<p>La moyenne des travailleurs se calcule diff\u00e9remment selon qu\u2019il s\u2019agit de travailleurs ordinaires ou int\u00e9rimaires. Ainsi, si l\u2019entreprise atteint  presque le seuil des 50 ou 100 travailleurs et doit encore engager du personnel en 2015, il pourra \u00eatre pr\u00e9f\u00e9rable de recruter des travailleurs ordinaires plut\u00f4t que des travailleurs int\u00e9rimaires, en tout cas en ce qui concerne le 4e trimestre de 2015.<\/p>\n<p>La moyenne des travailleurs ordinaires se calcule en divisant par 365 le total des jours civils compris dans chaque p\u00e9riode commen\u00e7ant \u00e0 la date de l\u2019entr\u00e9e en service et se terminant \u00e0 la date de sortie du service pour chaque travailleur, et ce au cours des 4 trimestres de l\u2019ann\u00e9e 2015.<\/p>\n<p>Par contre, la moyenne des travailleurs int\u00e9rimaires se calcule en divisant par 92 le total des jours civils pendant lesquels chaque int\u00e9rimaire aura \u00e9t\u00e9 inscrit dans l\u2019annexe au registre g\u00e9n\u00e9ral du personnel au cours du 4e trimestre de l\u2019ann\u00e9e 2015.<\/p>\n<p>Exemple concret : un int\u00e9rimaire occup\u00e9 \u00e0 temps plein durant tout le dernier trimestre 2015, comptera pour une unit\u00e9 (= 92\/92). Par contre, un travailleur ordinaire engag\u00e9 \u00e0 temps plein durant cette m\u00eame p\u00e9riode, dans le cadre d&rsquo;un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e (par exemple) ne comptera, quant \u00e0 lui, que pour 0,25 unit\u00e9 (= 92\/365).<\/p>\n<p>On voit donc toute l&rsquo;importance de bien se pr\u00e9parer \u00e0 ce nouveau challenge qui accompagnera nos organisations durant les 4 prochaines ann\u00e9es!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les prochaines \u00e9lections sociales, qui installeront ou renouvelleront les organes sociaux de l\u2019entreprise, se tiendront en principe en mai 2016.
