Depuis lors, le gouvernement a demand\u00e9 aux partenaires sociaux r\u00e9unis dans le cadre du Conseil National du Travail d&rsquo;\u00e9laborer une proposition de mise en oeuvre interprofessionnelle afin d&rsquo;\u00e9viter que le dispositif ne soit discut\u00e9 au niveau des secteurs. Malheureusement, patronat et syndicats ne sont pas parvenus \u00e0 s&rsquo;entendre sur le sujet.<!--more--><\/p>\n<p>La FEB se dit\u00a0favorable \u00e0 l&rsquo;\u00e9laboration d&rsquo;un r\u00e9gime intelligent en mati\u00e8re d&rsquo;\u00e9pargne-carri\u00e8re. Elle regrette qu&#8217;employeurs et syndicats ne se soient pas mis d&rsquo;accord au sein du Conseil national du travail (CNT). <em>\u00ab\u00a0Le 1er ao\u00fbt 2017, le ministre de l&rsquo;Emploi avait accord\u00e9 aux partenaires sociaux, qui n&rsquo;\u00e9taient pas en faveur de l&rsquo;approche sectorielle, un d\u00e9lai de 6 mois pour pr\u00e9senter une proposition interprofessionnelle propre au sein du CNT. Ils ont \u00e9chou\u00e9.\u00a0\u00bb<\/em><\/p>\n<p>Que pr\u00e9voyait la loi sur le sujet de\u00a0l&rsquo;\u00e9pargne-carri\u00e8re? <em>\u00ab\u00a0Lors de la conclusion d&rsquo;une convention collective de travail (CCT) sectorielle et\/ou d&rsquo;entreprise, les travailleurs ont la possibilit\u00e9 d&rsquo;\u00e9pargner du &lsquo;temps&rsquo; qu&rsquo;ils pourront ult\u00e9rieurement prendre sous la forme de cong\u00e9s. Ainsi, les travailleurs pourraient davantage prendre leur carri\u00e8re en main et d\u00e9cider eux-m\u00eames quand ils jugent n\u00e9cessaire de prendre une pause.\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Quel est donc le\u00a0r\u00e9gime qui entre en vigueur ?<\/em><\/strong><\/p>\n<p>Partant de ce constat d&rsquo;\u00e9chec, la FEB explique <em>\u00ab\u00a0d\u00e8s demain, tous les secteurs reconnus dans notre pays auront la possibilit\u00e9 d&rsquo;organiser l&rsquo;\u00e9pargne-carri\u00e8re. A d\u00e9faut d&rsquo;accord au niveau sectoriel dans un d\u00e9lai de 6 mois, le cadre peut en \u00eatre \u00e9labor\u00e9 dans une CCT d&rsquo;entreprise. Ce syst\u00e8me ne permettra pas d&rsquo;\u00e9pargner des jours de vacances l\u00e9gales, mais notamment des heures suppl\u00e9mentaires qui ne doivent \u00eatre r\u00e9cup\u00e9r\u00e9es, des jours de cong\u00e9 conventionnels, le solde des horaires flottants. Le syst\u00e8me repose sur le volontariat (secteur, employeur, travailleur).\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Retour sur l&rsquo;\u00e9chec des n\u00e9gociations<\/strong><\/em><\/p>\n<p>Il semble que le foss\u00e9 entre les partenaires sociaux \u00e9tait trop important. <em>\u00ab\u00a0Les employeurs demandent surtout plus de travail sur mesure au niveau de chaque entreprise et souhaitent un cadre qui soit facile \u00e0 appliquer. Les syndicats craignent, \u00e0 tort, que ce syst\u00e8me soit utilis\u00e9 de mani\u00e8re abusive pour inciter les travailleurs \u00e0 prester davantage d&rsquo;heures suppl\u00e9mentaires.\u00a0\u00bb<\/em><\/p>\n<p>Selon Monica De Jonghe, conseill\u00e8re \u00e0 la FEB,<em> \u00ab\u00a0la mise en place d&rsquo;un nouveau r\u00e9gime en plus de tous les r\u00e9gimes de cong\u00e9s d\u00e9j\u00e0 existants n&rsquo;est pas id\u00e9ale et devrait plut\u00f4t s&rsquo;inscrire dans le cadre d&rsquo;un exercice plus large relatif \u00e0 la conciliation travail\/vie priv\u00e9e, ce qui n&rsquo;est pas le cas aujourd&rsquo;hui.\u00a0\u00bb<\/em><\/p>\n<p>Ainsi, le r\u00e9gime qui entre en vigueur ne prend pas en compte un certain nombre d&rsquo;\u00e9l\u00e9ments cruciaux : l&rsquo;allongement des carri\u00e8res, la mobilit\u00e9 des travailleurs et la probl\u00e9matique du genre: <em>\u00ab\u00a0les femmes seront tent\u00e9es de prendre leurs cong\u00e9s pendant leur carri\u00e8re afin de mieux concilier le travail et la vie de famille. Les hommes, en revanche, garderont les jours \u00e9pargn\u00e9s pour la fin de leur carri\u00e8re. Cela ne contribuera nullement \u00e0 une meilleure r\u00e9partition des t\u00e2ches.\u00a0Le r\u00e9gime qui entrera en vigueur ne favorise aucunement l&rsquo;\u00e9galit\u00e9 entre hommes et femmes.
