La FGTB appelle les interlocuteurs concern\u00e9s \u2013 les employeurs et les autorit\u00e9s \u2013 \u00e0 leurs responsabilit\u00e9s, estimant que <em>\u00ab\u00a0trop de travailleurs sont aujourd\u2019hui abandonn\u00e9s \u00e0 leur sort lorsque survient une restructuration d\u2019entreprise.\u00a0\u00bb<\/em><!--more--><\/p>\n<p>La FGTB explique, via communiqu\u00e9, pourquoi il est n\u00e9cessaire de revoir rapidement les dispositions pr\u00e9vues dans la Loi Renault: <em>\u00ab\u00a0Il y a 20 ans, elle\u00a0constituait une v\u00e9ritable \u00e9volution, un progr\u00e8s vers une politique de licenciement plus humaine et aujourd\u2019hui encore elle prouve son utilit\u00e9. La loi oblige ainsi les employeurs \u00e0 informer leurs travailleurs en temps utile et \u00e0 entamer une concertation avec les organisations syndicales. Cette phase d\u2019information poursuit le double objectif d\u2019aborder les cons\u00e9quences sociales des vagues de licenciements envisag\u00e9es et de prendre en consid\u00e9ration les \u00e9ventuelles alternatives envisageables afin de limiter autant que possible la perte d\u2019emploi.\u00a0Et pourtant la loi Renault est loin d\u2019\u00eatre parfaite\u2026\u00a0Tout d\u2019abord, nous constatons sur le terrain que la d\u00e9cision de licencier est prise bien avant que les travailleurs ne soient impliqu\u00e9s. Ensuite, le banc patronal ne semble pas ou tr\u00e8s peu dispos\u00e9 \u00e0 n\u00e9gocier des alternatives. Or, les chiffres d\u00e9montrent que lorsqu\u2019il y a des n\u00e9gociations, la perte d\u2019emplois est diminu\u00e9e en moyenne de 7%. Ce n\u2019est que 7%, mais ceci prouve que cela donne des r\u00e9sultats et qu\u2019on peut et doit mieux faire. Ce faible r\u00e9sultat est principalement d\u00fb aux employeurs qui ne respectent pas la concertation sociale.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Quid des petites entreprises et des contrats pr\u00e9caires ?<\/strong><\/em><\/p>\n<p>Le syndicat socialiste regrette des r\u00e9sultats mitig\u00e9s et pointe les situations dans lesquelles la Loi se r\u00e9v\u00e8le inop\u00e9rante ou presque&#8230; <em>\u00ab\u00a0Nous constatons aussi que lorsqu\u2019un plan social existe, celui-ci est dans beaucoup de cas limit\u00e9 au strict minimum l\u00e9gal. Et certainement dans les petites entreprises.<\/em><br \/>\n<em> Une autre limite de la loi Renault r\u00e9side dans le fait que beaucoup de travailleurs ne sont tout simplement pas pris en consid\u00e9ration. Ainsi, des travailleurs qui travaillent avec un contrat temporaire ou d\u2019int\u00e9rim sont exclus tout comme les travailleurs des sous-traitants. \u00c0 cet \u00e9gard, la FGTB consid\u00e8re comme anormal que les travailleurs des sous-traitants qui d\u00e9pendent fortement du donneur d\u2019ordre, ne soient pas inform\u00e9s d\u2019une restructuration, ne soient pas impliqu\u00e9s dans la concertation et que l\u2019entreprise en restructuration qui est donneuse d\u2019ordre n\u2019assume pas ses responsabilit\u00e9s. La FGTB exige d\u2019urgence que les travailleurs des sous-traitants soient couverts par le plan social de l\u2019entreprise donneuse d\u2019ordre en restructuration.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Les entreprises sont-elles en capacit\u00e9 d&rsquo;anticiper ?<\/strong><\/em><\/p>\n<p>Et de poursuivre : <em>\u00ab\u00a0Enfin, il nous parait primordial d\u2019\u00e9viter ces situations dramatiques et d\u2019\u00e9tablir une r\u00e9elle politique de pr\u00e9vention. Des restructurations sauvages et d\u2019importantes vagues de licenciements peuvent \u00eatre \u00e9vit\u00e9es. Pour ce faire, les entreprises doivent anticiper et pr\u00e9voir. Cette anticipation des d\u00e9fis structurels \u00e0 venir peut se faire, \u00e0 titre d\u2019exemple, au travers d\u2019un r\u00e9el investissement dans la formation des travailleurs. Sur ce point particulier, nous exigeons \u00e9galement une r\u00e9elle concertation.\u00a0\u00bb<\/em><\/p>\n<p>Conclusion :\u00a0apr\u00e8s 20 ans, la FGTB estime que la loi Renault doit urgemment \u00eatre r\u00e9vis\u00e9e et am\u00e9lior\u00e9e. <em>\u00ab\u00a0Cette r\u00e9vision doit se faire dans un esprit constructif et au travers d\u2019une concertation sociale. Depuis trop longtemps, les travailleurs sont victimes de ces lacunes.
