L\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes rappelle que les probl\u00e8mes soulev\u00e9s par les travailleuses peuvent relever d\u2019une discrimination.<!--more--><\/p>\n<p>L\u2019Institut s\u2019est joint \u00e0 l\u2019action d\u2019une femme qui avait \u00e9t\u00e9 licenci\u00e9e en raison de ses absences li\u00e9es \u00e0 ses traitements de f\u00e9condation in vitro. Le Tribunal du travail d\u2019Anvers a reconnu en avril 2017 qu\u2019une discrimination d&rsquo;une femme en raison de traitement de fertilit\u00e9 revient \u00e0 une discrimination fond\u00e9e sur le sexe puisque seules les femmes sont sujet \u00e0 un traitement de fertilit\u00e9 et donc \u00e0 en subir les cons\u00e9quences n\u00e9gatives \u00e9ventuelles dans le cadre des relations de travail.<\/p>\n<p>En 2013, un employeur jugeait injustifi\u00e9es les absences de sa travailleuse pour raison m\u00e9dicale dues \u00e0 ses nombreux traitements de f\u00e9condation in vitro et des probl\u00e8mes de sant\u00e9 cons\u00e9cutifs. Les t\u00e9moignages permettaient, selon le tribunal, de d\u00e9duire que l\u2019employeur savait que la femme suivait un traitement FIV qui engendrait ses absences. Le tribunal a suivi l&rsquo;argument de l&rsquo;Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes selon lequel le stade du traitement FIV n&rsquo;est pas pertinent pour appr\u00e9cier l&rsquo;aspect discriminatoire. Apr\u00e8s tout, le traitement m\u00e9dical en question est fond\u00e9 sur la nature sp\u00e9cifique au genre et rel\u00e8ve donc du crit\u00e8re de la discrimination fond\u00e9e sur le sexe. En outre, le tribunal a fait valoir que le licenciement n&rsquo;aurait pas eu lieu si la femme n&rsquo;avait pas subi de traitement FIV. Sans ce traitement elle aurait \u00e9t\u00e9 moins absente du travail, alors que c\u2019\u00e9tait le motif du licenciement pour l\u2019employeur. Ainsi, comme la travailleuse a \u00e9t\u00e9 trait\u00e9e moins favorablement en raison de ses absences dues au traitement FIV, elle a \u00e9t\u00e9 victime d&rsquo;une discrimination directe fond\u00e9e sur le sexe. L\u2019employeur fut condamn\u00e9 \u00e0 lui verser une indemnit\u00e9 \u00e9quivalente \u00e0 six mois de salaire brut, d&rsquo;un montant de 11.000\u20ac.<\/p>\n<p><em>\u00ab\u00a0L\u2019Institut avait fait \u00e9tat, fin 2017, lors de sa recherche \u00ab Grossesse et maternit\u00e9 au travail : Les exp\u00e9riences des candidates, des travailleuses et des ind\u00e9pendantes en Belgique \u00bb et le lancement de sa r\u00e9cente campagne \u00ab Maman reste \u00e0 bord \u00bb, des nombreuses discriminations fond\u00e9es sur le sexe dont sont victimes les travailleuses en raison de leur (\u00e9ventuelle) grossesse ou maternit\u00e9 \u00e0 tous les stades de l\u2019emploi. Or, la grossesse, la maternit\u00e9 et la procr\u00e9ation m\u00e9dicalement assist\u00e9e sont des r\u00e9alit\u00e9s physiques qui ne concernent que les femmes et qui ne peuvent faire l\u2019objet de traitements d\u00e9favorables ou discriminations li\u00e9es \u00e0 ces situations\u00a0\u00bb<\/em>\u00a0rappelle Michel Pastel, Directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes.<\/p>\n<p>En Belgique, pr\u00e8s d\u2019un couple sur six souffre d\u2019un probl\u00e8me d\u2019infertilit\u00e9. De ce fait, certains couples ont recourt \u00e0 la f\u00e9condation in vitro (FIV) ou plus g\u00e9n\u00e9ralement la procr\u00e9ation m\u00e9dicalement assist\u00e9e.\u00a0Traitement exigeant et contraignant qui implique des cons\u00e9quences, m\u00eame sur le lieu de travail. Il est souvent difficile pour le couple de concilier leur emploi et leur suivi m\u00e9dical.<\/p>\n<p>Pour \u00e9viter que d\u2019autres travailleuses se retrouvent dans cette situation, l\u2019Institut a d\u00e9velopp\u00e9 une brochure d\u2019informations \u00e0 destination des travailleuses qui suivent un traitement de f\u00e9condation in vitro afin de les informer sur leurs droits et devoirs et les mesures de protection qui les couvrent pendant leur traitement. L\u2019Institut recommande, par exemple, aux travailleuses d\u2019informer par \u00e9crit et par recommand\u00e9 leur employeur de leur traitement m\u00e9dical, puis de la grossesse. Elles seront ainsi prot\u00e9g\u00e9es contre la discrimination.<br \/>\nLa publication \u00ab\u00a0<em>F\u00e9condation in vitro et travail : un parcours de combattante.
