Les syndicats veulent rappelle \u00e0 quel point il est crucial que les entreprises qui entament une proc\u00e9dure de restructuration n\u2019abandonnent pas \u00e0 leur sort les travailleurs des sous-traitants durement et directement touch\u00e9s par les projets de restructuration.<!--more--><br \/>\nAfin d\u2019am\u00e9liorer la Loi Renault, les organisations syndicales proposent quatre modifications :<br \/>\n1. La phase de concertation avec les repr\u00e9sentants des travailleurs doit se focaliser sur la conclusion d\u2019un plan social : informer les travailleurs ne suffit pas. Elle doit \u00e9galement viser au maximum \u00e0 limiter l\u2019impact social n\u00e9gatif d\u2019une restructuration. Nous consid\u00e9rons que la l\u00e9gislation actuelle ne met pas l\u2019accent sur une approche qui vise \u00e0 trouver des solutions<\/p>\n<p>2. Les syndicats proposent que l\u2019obligation d\u2019informer les organes de concertation soit \u00e9tendue \u00e0 toutes les situations qui peuvent avoir un impact n\u00e9gatif sur l\u2019emploi. Lors de cette phase d\u2019information et de consultation, il est imp\u00e9ratif de prendre en compte les alternatives syndicales \u00e0 une restructuration. Actuellement, ceci est rarement le cas. Bien souvent, la direction a pr\u00e9par\u00e9 son plan et ne souhaite pas y d\u00e9roger. Tout rejet des propositions syndicales devrait \u00eatre s\u00e9rieusement motiv\u00e9.<\/p>\n<p>3. Les grandes entreprises se sont transform\u00e9es en structures o\u00f9 la sous-traitance joue un r\u00f4le crucial. Ces sous-traitants d\u00e9pendent alors souvent d\u2019un seul gros client. Aujourd\u2019hui, ils sont pourtant exclus de la proc\u00e9dure d\u2019information lorsque ce client proc\u00e8de \u00e0 une restructuration ou \u00e0 une fermeture. Les syndicats veulent que les sous-traitants qui d\u00e9pendent de ce m\u00eame client pour au moins 75% de leur chiffre d\u2019affaires soient inform\u00e9s par ce client de l\u2019impact des restructurations.<br \/>\nLe sous-traitant sera alors en mesure d\u2019informer directement les membres de ses organes de concertation.<\/p>\n<p>4. Les travailleurs des sous-traitants qui d\u00e9pendent \u00e0 100% d\u2019un donneur d\u2019ordre doivent figurer dans le plan social n\u00e9goci\u00e9 lorsque le donneur d\u2019ordre proc\u00e8de \u00e0 une restructuration. Il faut \u00e9galement pr\u00e9voir une r\u00e9glementation pour les sous-traitants qui d\u00e9pendent \u00e0 75% au moins d\u2019une entreprise restructur\u00e9e. Le plan social doit aussi s\u2019appliquer aux travailleurs int\u00e9rimaires et aux travailleurs sous contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e, actifs dans l\u2019entreprise \u00e0 l\u2019annonce de la restructuration.<br \/>\nLes syndicats estiment \u00e9galement qu\u2019il n\u2019est pas raisonnable de nuire \u00e0 l\u2019impartialit\u00e9 du conciliateur social en le chargeant de clore la p\u00e9riode d\u2019information et de consultation. De m\u00eame, il n\u2019est pas sage de limiter la phase d\u2019information et de consultation dans le temps.
