









{"id":5798,"date":"2018-03-28T16:48:30","date_gmt":"2018-03-28T14:48:30","guid":{"rendered":"http:\/\/www.peoplesphere.be\/fr\/?p=5798"},"modified":"2018-03-28T16:48:30","modified_gmt":"2018-03-28T14:48:30","slug":"licenciement-6-premiers-mois-de-relation-de-travail-retour-de-clause-dessai-effectif","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/licenciement-6-premiers-mois-de-relation-de-travail-retour-de-clause-dessai-effectif\/","title":{"rendered":"Licenciement dans les 6 premiers mois de la relation de travail: le retour de la clause d&rsquo;essai est effectif."},"content":{"rendered":"<p>En suite de l\u2019accord de l\u2019\u00e9t\u00e9 2017, la Chambre a adopt\u00e9 en s\u00e9ance pl\u00e9ni\u00e8re de ce jeudi 22 mars 2018 la proposition de loi relative au renforcement de la croissance \u00e9conomique et de la coh\u00e9sion sociale, qui modifie la dur\u00e9e des d\u00e9lais de pr\u00e9avis applicables lors d\u2019un licenciement notifi\u00e9 au cours des 6 premiers mois de la relation de travail.<!--more--><\/p>\n<p>La FEB souligne que nous pouvons retenir que, en cas d\u2019anciennet\u00e9 inf\u00e9rieure \u00e0 3 mois, le d\u00e9lai passe \u00e0 1 semaine.<br \/>\nLes nouveaux d\u00e9lais entreront en vigueur le premier jour du deuxi\u00e8me mois suivant celui de la publication de la loi au Moniteur belge.<\/p>\n<p>Le retour \u00e0 l\u2019ancien d\u00e9lai \u2018clause d\u2019essai\u2019 moyennant un r\u00e9gime encore plus flexible sera donc bient\u00f4t effectif.\u00a0Ce d\u00e9lai d\u20191 semaine correspond au pr\u00e9avis \u2018clause d\u2019essai\u2019 qui \u00e9tait en vigueur avant l\u2019introduction de la loi relative au statut unique. En effet, la loi pr\u00e9voyait un d\u00e9lai d\u20191 semaine pour un employ\u00e9 li\u00e9 par une clause d\u2019essai et, en cas d\u2019application du r\u00e9gime d\u00e9rogatoire de l\u2019ancien article 60 de la loi du 3 juillet 1978, la m\u00eame dur\u00e9e pour un ouvrier.<\/p>\n<p>L&rsquo;organisation patronale commente : <em>\u00ab\u00a0En tant que compensation \u00e0 la suppression de l\u2019ancienne p\u00e9riode d\u2019essai, cette mesure est la bienvenue.\u00a0Certes, le d\u00e9lai d\u20191 semaine ne s\u2019appliquera qu\u2019aux 3 premiers mois, contrairement \u00e0 la p\u00e9riode de 6 mois \u2013 voire 12 \u2013 sur laquelle portaient les anciennes clauses d\u2019essai d\u2019employ\u00e9 ou l\u2019ancien article 60. Mais, sous un autre aspect, le pr\u00e9avis peut d\u00e9sormais prendre cours d\u00e8s le lundi suivant sa notification et ce, m\u00eame pendant le premier mois de la relation.\u00a0La notification d\u2019un pr\u00e9avis pendant le premier mois de service n\u2019aura jamais \u00e9t\u00e9 aussi souple!\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Les contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e concern\u00e9s, eux aussi.<\/em><\/strong><\/p>\n<p>Pour rappel, depuis l\u2019entr\u00e9e en vigueur de la loi relative au statut unique, il peut \u00eatre mis fin \u00e0 un CDD pendant la premi\u00e8re moiti\u00e9 de sa dur\u00e9e \u2013 limit\u00e9e \u00e0 6 mois \u2013 moyennant les m\u00eames d\u00e9lais que ceux applicables au contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, par application des articles 40 \u00a72 et 37\/2 de la loi du 3 juillet 1978.<\/p>\n<p>En cas de r\u00e9siliation avant terme, le d\u00e9lai s\u2019\u00e9l\u00e8vera donc \u00e0 1 semaine si, par exemple, le pr\u00e9avis prend cours pendant les 3 premiers mois et que la dur\u00e9e du CDD s\u2019\u00e9l\u00e8ve au moins \u00e0 6 mois.<\/p>\n<p><em><strong>Un retour implicite <\/strong><\/em><\/p>\n<p>Il n\u2019y a pas de r\u00e9introduction de la \u2018clause d\u2019essai\u2019 proprement dite : seuls les d\u00e9lais l\u00e9gaux sont modifi\u00e9s.\u00a0D\u00e8s lors, ne se poseront plus les anciennes questions pratiques qui y \u00e9taient li\u00e9es :<\/p>\n<p>&#8211; l\u2019exigence d\u2019une clause \u00e9crite, convenue au plus tard au moment de l\u2019entr\u00e9e en service ;<br \/>\n&#8211; la prolongation de la p\u00e9riode d\u2019essai en cas de suspension de l\u2019ex\u00e9cution du contrat ;<br \/>\n&#8211; les incidences d\u2019une incapacit\u00e9 de travail sup\u00e9rieure \u00e0 7 jours survenant en p\u00e9riode d\u2019essai.<\/p>\n<p>Ce qui est \u00e0 nouveau permis, c\u2019est de mettre fin au contrat moyennant un pr\u00e9avis d\u20191 semaine au cours des premiers mois.\u00a0Que subsiste-t-il alors de la clause d\u2019essai ?\u00a0La clause d\u2019essai reste op\u00e9rante pour trois formes de contrat de travail :<\/p>\n<p>&#8211; les contrats d\u2019occupation d\u2019\u00e9tudiant, o\u00f9 la p\u00e9riode d\u2019essai de 3 jours est \u2018automatique\u2019 ;<br \/>\n&#8211; les contrats de travail temporaire et int\u00e9rimaire, o\u00f9 une p\u00e9riode d\u2019essai de 3 jours est pr\u00e9vue mais \u00e0 laquelle il peut \u00eatre d\u00e9rog\u00e9.<\/p>\n<p><em>Source : FEB<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>En suite de l\u2019accord de l\u2019\u00e9t\u00e9 2017, la Chambre a adopt\u00e9 en s\u00e9ance pl\u00e9ni\u00e8re de ce jeudi 22 mars 2018 la proposition de loi relative au renforcement de la croissance \u00e9conomique et de la coh\u00e9sion sociale, qui modifie la dur\u00e9e [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[65,10],"tags":[1258,1244,1881,1207,134,378,523,1880],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.0 -
