Les nouveaux d\u00e9lais de pr\u00e9avis d\u00e9cid\u00e9s par l&rsquo;ex\u00e9cutif \u00e0 l&rsquo;issue de la concertation autour du &lsquo;faux&rsquo; retour de la p\u00e9riode d&rsquo;essai entrent en vigueur au 1er mai 2018. Vos conseillers juridiques rappellent les nouvelles r\u00e8gles, en attirant notre attention sur quelques menus d\u00e9tails&#8230;<!--more--><\/p>\n<p>Les d\u00e9lais de pr\u00e9avis exprim\u00e9s en semaine ont donc \u00e9t\u00e9 revus. En bref, \u00e0 partir du 1er mai 2018, les travailleurs disposant d&rsquo;une anciennet\u00e9 inf\u00e9rieure \u00e0 3 mois b\u00e9n\u00e9ficieront d&rsquo;un pr\u00e9avis d&rsquo;une semaine seulement (contre 2 semaines auparavant).<br \/>\nEn cas d&rsquo;anciennet\u00e9 de 3 \u00e0 4 mois, le pr\u00e9avis sera d&rsquo;une dur\u00e9e de 3 semaines.<br \/>\nEn cas d&rsquo;anciennet\u00e9 de 4 \u00e0 5 mois, le pr\u00e9avis sera d&rsquo;une dur\u00e9e de 4 semaines.<br \/>\nEn cas d&rsquo;anciennet\u00e9 de 5 \u00e0 6 mois, le pr\u00e9avis sera d&rsquo;une dur\u00e9e de 5 semaines.<\/p>\n<p>Le pr\u00e9avis sort ses effets le 3e jour ouvrable suivant son envoi par pli recommand\u00e9, date \u00e0 laquelle le travailleur est \u00ab cens\u00e9 \u00bb avoir re\u00e7u la lettre. D\u00e8s lors le pr\u00e9avis remis \u00e0 la poste un mercredi sort ses effets le samedi de la m\u00eame semaine, tandis que le pr\u00e9avis d\u00e9pos\u00e9 un jeudi sort ses effets le lundi de la semaine suivante.<\/p>\n<p>Le pr\u00e9avis prend cours le lundi suivant le jour o\u00f9 il a sorti ses effets. Dans les deux exemples, il s\u2019agit du surlendemain et du lundi de la semaine suivante, soit 7 jours plus tard.<br \/>\nLa dur\u00e9e du pr\u00e9avis est d\u00e9termin\u00e9e par l\u2019anciennet\u00e9 du travailleur acquise au moment o\u00f9 le pr\u00e9avis prend cours.<br \/>\nDans le cas du licenciement imm\u00e9diat, donc sans pr\u00e9avis, l\u2019indemnit\u00e9 correspondra au d\u00e9lai de pr\u00e9avis en vigueur et calcul\u00e9 en fonction de l\u2019anciennet\u00e9 acquise au jour de la rupture.<\/p>\n<p><em>Source : FEB<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Il conviendra d&rsquo;\u00eatre attentif.
