L\u2019Institut pour l&rsquo;\u00e9galit\u00e9 Femme-Homme a fait ce constat suite \u00e0 une affaire o\u00f9 une g\u00e9rante de magasin a \u00e9t\u00e9 licenci\u00e9e pour avoir d\u00e9fendu la s\u00e9lection d\u2019une candidate enceinte au cours d\u2019une proc\u00e9dure de recrutement. Le Tribunal du travail d\u2019Anvers a d\u00e9cid\u00e9 de poser une question pr\u00e9judicielle \u00e0 la Cour de justice de l\u2019Union europ\u00e9enne afin de d\u00e9terminer si la loi belge en mati\u00e8re de protection des t\u00e9moins est contraire au droit europ\u00e9en.<!--more--><\/p>\n<p>En 2015, la g\u00e9rante d\u2019une filiale d\u2019une cha\u00eene de magasins a voulu renforcer son \u00e9quipe en engageant du personnel suppl\u00e9mentaire. Elle a choisi la personne, selon elle, la plus comp\u00e9tente. Le si\u00e8ge social s\u2019est oppos\u00e9 \u00e0 ce choix au motif que la candidate \u00e9tait enceinte. La g\u00e9rante du magasin a rappel\u00e9 que la loi belge interdit la discrimination \u00e0 l\u2019\u00e9gard des femmes enceintes et a plaid\u00e9 plusieurs fois en faveur du recrutement de la candidate, mais le si\u00e8ge social a continu\u00e9 \u00e0 refuser.<br \/>\nL\u2019Institut a re\u00e7u une plainte de la femme enceinte et a contact\u00e9 le si\u00e8ge social de la cha\u00eene de magasins. Le si\u00e8ge social a pr\u00e9tendu que la g\u00e9rante avait d\u00e9cid\u00e9 de sa propre initiative de ne pas recruter la candidate. La g\u00e9rante du magasin a \u00e9t\u00e9 licenci\u00e9e \u00e0 la suite des discussions concernant cette affaire.<\/p>\n<p>L\u2019Institut a port\u00e9 le dossier en justice, avec la candidate enceinte et la g\u00e9rante licenci\u00e9e. Le 23 mai 2018, le Tribunal du travail a jug\u00e9 que la candidate avait effectivement fait l\u2019objet d&rsquo;une discrimination en raison de sa grossesse. Pour la g\u00e9rante la question est plus compliqu\u00e9e. La Loi-Genre pr\u00e9voit une protection contre les repr\u00e9sailles sur les t\u00e9moins de discrimination tels que le licenciement, mais uniquement lorsqu\u2019un t\u00e9moignage sign\u00e9 et dat\u00e9 a \u00e9t\u00e9 r\u00e9dig\u00e9. En l&rsquo;absence d&rsquo;un tel document au moment de son licenciement, la g\u00e9rante du magasin n\u2019est donc pas prot\u00e9g\u00e9e. Cependant, la Directive europ\u00e9enne n\u2019est pas aussi stricte que la l\u00e9gislation belge en ce qui concerne les conditions pour b\u00e9n\u00e9ficier, en tant que t\u00e9moin, d\u2019une protection contre d\u2019\u00e9ventuelles repr\u00e9sailles.<\/p>\n<p><em>\u00ab Les t\u00e9moins peuvent jouer un r\u00f4le crucial dans la r\u00e9duction de la discrimination de genre. Ils augmentent les chances de prouver la discrimination et donnent aux victimes le sentiment qu\u2019elles ne sont pas seules. Ils doivent \u00eatre suffisamment prot\u00e9g\u00e9s. \u00bb<\/em> d\u00e9clare Michel Pasteel, directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes.<\/p>\n<p>Le Tribunal du travail a d\u00e9cid\u00e9 de poser une question pr\u00e9judicielle \u00e0 la Cour de justice de l\u2019Union europ\u00e9enne. Celle-ci devra maintenant d\u00e9cider si les conditions belges relatives \u00e0 la protection des t\u00e9moins pr\u00e9vues dans la Loi-Genre sont contraires au droit europ\u00e9en.
