Le Tribunal du travail de Louvain a condamn\u00e9 un magasin de v\u00eatement pour discrimination fond\u00e9e sur le sexe. Il avait refus\u00e9 la candidature d\u2019un homme au motif qu\u2019il voulait engager une femme.<!--more--><\/p>\n<p><em>\u00ab [\u2026] Malheureusement, je dois vous donner un feed-back n\u00e9gatif. Nous sommes \u00e0 la recherche d\u2019une coll\u00e8gue de sexe f\u00e9minin pour cette fonction. [\u2026] \u00bb<\/em> Voil\u00e0 la r\u00e9ponse qu\u2019un candidat masculin a re\u00e7ue apr\u00e8s avoir r\u00e9pondu \u00e0 une offre d\u2019emploi comme \u00ab gestionnaire de stock \u00bb dans un magasin de v\u00eatement. L\u2019homme a alors port\u00e9 plainte \u00e0 l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes pour discrimination \u00e0 l\u2019emploi. Le Tribunal du travail de Louvain a en effet estim\u00e9 que la seule raison du refus \u00e9tait le sexe du candidat et constituait une discrimination directe. Le magasin a \u00e9t\u00e9 condamn\u00e9, conform\u00e9ment \u00e0 la Loi Genre, \u00e0 payer plus de 13 000 \u20ac de dommages-int\u00e9r\u00eats au candidat, l\u2019\u00e9quivalent de six mois de r\u00e9mun\u00e9ration brute, et une indemnit\u00e9 de 1 \u20ac symbolique \u00e0 l\u2019Institut.<\/p>\n<p><em>\u00ab Le sexe ne d\u00e9termine pas les comp\u00e9tences professionnelles des candidat\u00b7e\u00b7s. Tr\u00e8s souvent, les employeurs sont encore convaincus que les femmes sont davantage destin\u00e9es \u00e0 certaines fonctions, et les hommes \u00e0 d\u2019autres. Ces convictions sont des id\u00e9es re\u00e7ues qui reposent sur des st\u00e9r\u00e9otypes et des pr\u00e9jug\u00e9s sexistes qui doivent disparaitre \u00bb<\/em> rapporte Michel Pasteel, directeur de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes.<\/p>\n<p>Dans cette affaire, il est clairement apparu que le sexe du candidat \u00e9tait la seule raison pour refuser sa candidature. Or, tout refus de recrutement en raison du genre, de l\u2019identit\u00e9 de genre ou de l\u2019expression de genre constitue une discrimination directe, prot\u00e9g\u00e9e par la Loi Genre. La loi s\u2019applique \u00e0 l\u2019ensemble du processus de recrutement, de l\u2019offre d\u2019emploi \u00e0 la s\u00e9lection. Toute candidature doit \u00eatre \u00e9valu\u00e9e sur base de crit\u00e8res objectifs en lien avec le poste \u00e0 pourvoir. L\u2019employeur est libre de choisir la personne la plus comp\u00e9tente, selon elle\/lui, mais sa libert\u00e9 est limit\u00e9e par le principe de non-discrimination. Si une personne pense avoir fait l\u2019objet d\u2019une discrimination, elle peut solliciter l\u2019aide de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes via le num\u00e9ro vert 0800\/12.800, via email (<a href=\"mailto:egalite.hommesfemmes@iefh.belgique.be\">egalite.hommesfemmes@iefh.belgique.be<\/a>) ou via le site internet (<a href=\"http:\/\/igvm-iefh.belgium.be\/fr\">http:\/\/igvm-iefh.belgium.be\/fr<\/a>).<\/p>\n<p><strong><em>La discrimination \u00e0 l\u2019emploi en chiffres<\/em><\/strong><\/p>\n<p>L\u2019Institut est r\u00e9guli\u00e8rement interpell\u00e9 pour des cas de discrimination li\u00e9s \u00e0 la situation professionnelle, pr\u00e8s de la moiti\u00e9 des signalements en 2017 (46%). Parmi ceux-ci, quatre signalements sur dix sont li\u00e9s au recrutement et \u00e0 la s\u00e9lection (42%). Les femmes restent les principales victimes de discrimination dans le milieu professionnel mais le recrutement semble \u00eatre une phase o\u00f9 les hommes signalent \u00eatre presque autant victimes de discrimination que les femmes.
