En pr\u00e8s d\u2019un an, le nombre de travailleurs pour lesquels le t\u00e9l\u00e9travail a \u00e9t\u00e9 enregistr\u00e9 dans payroll a augment\u00e9 de plus de 10 %. D\u2019une part, 65 % des employ\u00e9s estiment qu\u2019il \u00e9tait (tr\u00e8s) important de pouvoir d\u00e9cider de quel lieu ils effectuaient leur travail et, d\u2019autre part, 36 % b\u00e9n\u00e9ficient effectivement de cette option chez leur employeur.<!--more--><\/p>\n<p>65 % des travailleurs estiment qu\u2019il est important de pouvoir discuter du lieu \u00e0 partir duquel ils travaillent, 16 % d\u00e9clarent m\u00eame que ce choix est \u00ab tr\u00e8s important \u00bb. 68 % voudraient que leur employeur autorise le t\u00e9l\u00e9travail\/travail \u00e0 domicile.<\/p>\n<p>Micha\u00ebl Zahlen, consultant Legal &amp; Reward : <em>\u00ab Les employeurs ne doivent pas craindre que demain, tous leurs travailleurs effectuent leur travail de la maison. La majorit\u00e9, soit 64 %, vise un ou deux jours de t\u00e9l\u00e9travail par semaine, ce qui repr\u00e9sente somme toute une demande raisonnable dans bien des situations professionnelles. Si en outre, nous tenons compte du fait que le t\u00e9l\u00e9travail peut am\u00e9liorer l\u2019\u00e9quilibre entre travail et vie priv\u00e9e et att\u00e9nuer le probl\u00e8me de mobilit\u00e9, nous pouvons pr\u00e9sumer que le travail \u00e0 domicile gagnera encore en puissance. Son impact sur le march\u00e9 de l\u2019emploi grandira encore. Les employeurs qui offriront la possibilit\u00e9 d\u2019aborder et d\u2019organiser le t\u00e9l\u00e9travail auront une longueur d\u2019avance. \u00bb<\/em><\/p>\n<p><em><strong>37,5 % de t\u00e9l\u00e9travail enregistr\u00e9 en plus<\/strong><\/em><\/p>\n<p>Fin juillet 2018, l\u2019enregistrement du t\u00e9l\u00e9travail pr\u00e9sentait une hausse de 37,5 % durant les deux derni\u00e8res ann\u00e9es et demie. Micha\u00ebl Zahlen: <em>\u00ab Nous ne pouvons pas d\u00e9duire la hausse de la popularit\u00e9 du t\u00e9l\u00e9travail sur la base de ces chiffres, car il n\u2019est pas obligatoire d\u2019enregistrer le t\u00e9l\u00e9travail comme tel, \u00e0 moins qu\u2019une indemnit\u00e9 sp\u00e9cifique ne soit octroy\u00e9e pour celui-ci. Par contre, ces chiffres r\u00e9v\u00e8lent bien que le t\u00e9l\u00e9travail est en plein essor et que les entreprises recourent aux possibilit\u00e9s l\u00e9gales. Le t\u00e9l\u00e9travail a v\u00e9ritablement \u00e9volu\u00e9. \u00bb<\/em><\/p>\n<p>D\u2019autres changements sont \u00e0 pr\u00e9voir. Le t\u00e9l\u00e9travail s\u2019impose de plus en plus e.a. en tant qu\u2019argument de persuasion pour le recrutement dans le cadre de la guerre des talents. <em>\u00ab\u00a0Pr\u00e9cis\u00e9ment parce qu\u2019il s\u2019agit d\u2019un aspect important des RH, nous encourageons les employeurs \u00e0 utiliser les possibilit\u00e9s l\u00e9gales et \u00e0 fournir un bon encadrement et un bon suivi pour le t\u00e9l\u00e9travail.\u00a0\u00bb<\/em><\/p>\n<p><em><strong>Deux sortes de t\u00e9l\u00e9travail, deux cadres<\/strong><\/em><\/p>\n<p>Lorsqu\u2019un travailleur preste r\u00e9guli\u00e8rement un ou plusieurs jours de travail \u00e0 domicile (ou ailleurs en d\u00e9placement) en utilisant les technologies de l\u2019information, nous parlons de t\u00e9l\u00e9travail structurel. Pour le t\u00e9l\u00e9travail structurel, le Conseil National du Travail avait d\u00e9j\u00e0 conclu la CCT n\u00b0 85 qui d\u00e9termine les obligations de l\u2019employeur et du travailleur dans le cadre du t\u00e9l\u00e9travail. Les accords sont fix\u00e9s dans un accord sp\u00e9cifique (ou annexe au contrat de travail) qui doit contenir un certain nombre de mentions obligatoires. Naturellement, il se peut aussi qu\u2019un travailleur ne souhaite pas travailler \u00e0 domicile de mani\u00e8re syst\u00e9matique\/structurelle, mais occasionnellement. Cette r\u00e9glementation concernant le t\u00e9l\u00e9travail a \u00e9t\u00e9 transpos\u00e9e dans un cadre l\u00e9gal pour le t\u00e9l\u00e9travail occasionnel. Les motivations pour ce faire peuvent \u00eatre tr\u00e8s diverses (p.ex. : une grosse chute de neige soudaine, un rendez-vous urgent chez le dentiste, une gr\u00e8ve de train nationale ou une canalisation qui a saut\u00e9 \u00e0 la maison). Ce t\u00e9l\u00e9travail occasionnel a re\u00e7u un cadre l\u00e9gal avec la loi Peeters sur le travail faisable et maniable. Ce cadre d\u00e9termine les motivations pertinentes pour travailler exceptionnellement \u00e0 domicile. Le travailleur explique sa motivation \u00e0 l\u2019employeur et celui-ci peut refuser le t\u00e9l\u00e9travail occasionnel si la nature du travail n\u2019est pas conciliable avec le t\u00e9l\u00e9travail.<\/p>\n<p><em>\u00c0 propos des chiffres &#8211; les donn\u00e9es sont bas\u00e9es notamment sur l\u2019enqu\u00eate biennale qu\u2019ACERTA a fait r\u00e9aliser par le bureau d\u2019enqu\u00eate Indiville aupr\u00e8s de plus de 1700 travailleurs entre le 26 f\u00e9vrier et le 29 mars 2018.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le t\u00e9l\u00e9travail structurel semble \u00eatre en hausse.
