Dans un proc\u00e8s opposant l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes \u00e0 un magasin, le tribunal a pour la premi\u00e8re fois explicitement confirm\u00e9 que licencier une travailleuse en vue d\u2019atteindre un meilleur \u00e9quilibre au niveau de l\u2019effectif du personnel constitue une forme de discrimination.<!--more--><\/p>\n<p>Le propri\u00e9taire du magasin a \u00e9t\u00e9 condamn\u00e9 \u00e0 verser des dommages-int\u00e9r\u00eats de pr\u00e8s de 9.000 euros, mais il a d\u00e9cid\u00e9 de faire appel.\u00a0En 2016, une travailleuse employ\u00e9e dans un magasin de sport a re\u00e7u son C4. Le motif de licenciement \u00e9tait libell\u00e9 comme suit : <em>\u00ab r\u00e9partition \u00e9quilibr\u00e9e femmes-hommes dans le magasin \u00bb<\/em>. La dame a introduit une plainte aupr\u00e8s de son syndicat et ce dernier a contact\u00e9 l\u2019Institut pour l\u2019\u00e9galit\u00e9 des femmes et des hommes.<\/p>\n<p>Le 11 octobre 2018, le tribunal du travail de Gand a estim\u00e9 que le sexe de la travailleuse constituait la raison de son licenciement et que la d\u00e9cision de la licencier \u00e9tait donc de la discrimination. Le propri\u00e9taire du magasin a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer des dommages-int\u00e9r\u00eats \u00e0 la travailleuse.<\/p>\n<p>Le magasin a essay\u00e9 de se d\u00e9fendre en indiquant qu\u2019il \u00e9tait n\u00e9cessaire d\u2019atteindre une r\u00e9partition \u00e9quilibr\u00e9e des travailleuses et des travailleurs sur le lieu de travail parce que les femmes sont plus dou\u00e9es pour agencer les articles dans l\u2019\u00e9talage et que les clients pr\u00e9f\u00e8rent parfois \u00eatre servis plut\u00f4t par un homme ou par une femme. Le tribunal a estim\u00e9 que ces arguments \u00e9taient discriminatoires. Il en a d\u00e9duit que non seulement le licenciement individuel de la travailleuse \u00e9tait contraire \u00e0 la Loi Genre, mais aussi la politique de recrutement du magasin dans son ensemble. Par cons\u00e9quent, le tribunal a condamn\u00e9 le magasin \u00e0 verser des dommages-int\u00e9r\u00eats \u00e0 la dame, ainsi que des dommages-int\u00e9r\u00eats pour pr\u00e9judice moral de 1.300 euros \u00e0 l\u2019Institut.<\/p>\n<p><em>\u00ab Le sexe d\u2019une ou d\u2019un travailleur n\u2019a aucune influence sur ses comp\u00e9tences professionnelles. Il est d\u00e9pass\u00e9 de penser que les femmes r\u00e9alisent certaines t\u00e2ches automatiquement mieux que les hommes, ou vice-versa.
