Du point de vue syndical, le gouvernement intervient en effet de deux mani\u00e8res dans l\u2019accord du Groupe des Dix pour les autres b\u00e9n\u00e9ficiaires du RCC et les ch\u00f4meurs \u00e2g\u00e9s. Une attitude jug\u00e9e contraire \u00e0 son engagement pr\u00e9alable d\u2019honorer l\u2019accord social conclu entre partenaires sociaux, comme l&rsquo;explique la CSC.<!--more--><\/h1>\n<p>Les d\u00e9cisions du gouvernement concernant la disponibilit\u00e9 des demandeurs d\u2019emploi \u00e2g\u00e9s et des b\u00e9n\u00e9ficiaires du RCC ont \u00e9t\u00e9 communiqu\u00e9es ce 9 mars aux partenaires sociaux. Le Bureau national de la CSC a compar\u00e9 ces d\u00e9cisions \u00e0 l\u2019accord que le Groupe des Dix avait conclu la semaine derni\u00e8re.<\/p>\n<p>Celui-ci engage express\u00e9ment les signataires \u00e0 n\u00e9gocier des corrections en mati\u00e8re de disponibilit\u00e9 et est donc indissociable de l\u2019ensemble de l\u2019accord social 2015-2016 que le gouvernement a par ailleurs d\u00e9clar\u00e9 vouloir honorer int\u00e9gralement.<\/p>\n<p>Dans une logique visant \u00e0 \u00e9viter de remettre en cause unilat\u00e9ralement les droits des travailleurs qui ont op\u00e9r\u00e9 des choix sur la base des anciennes r\u00e8gles, le syndicat se f\u00e9licite des certitudes acquises pour:<\/p>\n<p>* tous ceux qui b\u00e9n\u00e9ficiaient d\u00e9j\u00e0 d\u2019un RCC fin 2014;<br \/>\n* tous ceux qui ont \u00e9t\u00e9 licenci\u00e9s avant le 1er janvier 2015 en vue d\u2019un RCC;<br \/>\n* les personnes en RCC licenci\u00e9es dans une entreprise en difficult\u00e9 ou restructuration, dans la mesure o\u00f9 la restructuration a \u00e9t\u00e9 annonc\u00e9e avant le 9 octobre 2014 (ind\u00e9pendamment de l\u2019\u00e2ge);<br \/>\n* tous les ch\u00f4meurs \u00e2g\u00e9s qui b\u00e9n\u00e9ficiaient d\u00e9j\u00e0 d\u2019une maxi-dispense de disponibilit\u00e9 \u00e0 partir du 31 d\u00e9cembre 2014.<\/p>\n<p>Toutefois, l&rsquo;intervention du gouvernement pour les autres b\u00e9n\u00e9ficiaires du RCC et les ch\u00f4meurs \u00e2g\u00e9s est jug\u00e9e contraire \u00e0 son engagement d\u2019honorer l\u2019accord social conclu entre partenaires sociaux.<br \/>\nPremi\u00e8rement, la notion de disponibilit\u00e9 \u201cpassive\u201d est remplac\u00e9e unilat\u00e9ralement par la notion de \u201cdisponibilit\u00e9 adapt\u00e9e\u201d, \u00e0 la fois n\u00e9buleuse et incertaine sur le plan juridique, selon la CSC. Une mesure jug\u00e9e <em>\u00ab\u00a0vexatoire et qui contraindrait les b\u00e9n\u00e9ficiaires de RCC et les ch\u00f4meurs \u00e2g\u00e9s \u00e0 d\u00e9montrer quotidiennement qu\u2019ils sollicitent un emploi, pour ensuite subir une sanction s\u2019ils s\u2019av\u00e8rent incapables de fournir suffisamment de preuves.\u00a0\u00bb<\/em><br \/>\nDeuxi\u00e8mement, le syndicat s&rsquo;oppose \u00e0 la prolongation des CCT-cadres \u00e0 partir de 2017 pour les RCC des ouvriers de la construction en incapacit\u00e9 de travail, des travailleurs qui comptabilisent 40 ans de carri\u00e8re et des travailleurs occup\u00e9s dans le cadre d\u2019horaires p\u00e9nibles (travail de nuit ou en \u00e9quipes-relais et horaires coup\u00e9s). Comme l&rsquo;indique la CSC: <em>\u00ab\u00a0le gouvernement exige d\u2019office une disponibilit\u00e9 adapt\u00e9e jusqu\u2019\u00e0 62 ans \u00e0 partir de 2017. Cette d\u00e9cision est en totale contradiction avec l\u2019accord conclu entre partenaires sociaux visant \u00e0 subordonner cet \u00e2ge \u00e0 l\u2019\u00e2ge d\u2019acc\u00e8s au RCC, qui sera fix\u00e9 dans des CCT-cadres  conclues \u00e0 partir de 2017, moyennant des n\u00e9gociations.\u00a0\u00bb<\/em><\/p>\n<p>La CSC part du principe que les autres partenaires qui ont sign\u00e9 l\u2019accord sur la disponibilit\u00e9 et l\u2019ont d\u00e9fendu sont parvenus au m\u00eame constat et que celui-ci sera adress\u00e9 par le Groupe des 10 au gouvernement d\u00e8s demain, puisque l\u2019accord conclu entre partenaires sociaux est un et indivisible.<\/p>\n<p>Par ailleurs, le syndicat d\u00e9nonce un manque de volont\u00e9 en mati\u00e8re de cr\u00e9ation d&#8217;emplois et l&rsquo;absence d&rsquo;initiatives cr\u00e9dibles de la part du gouvernement, ce qui serait \u00e0 l&rsquo;origine des discussions sur la disponibilit\u00e9.<\/p>\n<p>A suivre&#8230;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La d\u00e9cision du gouvernement visant \u00e0 modifier l&rsquo;accord du groupe des 10 ne passe pas, c&rsquo;est un euph\u00e9misme.
