Ce march\u00e9 du travail tr\u00e8s populaire, en pleine expansion, regroupe tous les petits contrats \u00e0 court terme ainsi que le travail freelance. Cette inadaptation pose probl\u00e8me, en t\u00e9moignent d\u2019ailleurs les nombreuses protestations et poursuites judiciaires entam\u00e9es dans notre pays \u00e0 l\u2019encontre d\u2019entreprises comme Uber et Takeaway.com qui sont les figures de proue de cette gig economy.<!--more--><\/p>\n<p>Selon PwC Legal, la Belgique va devoir s\u2019adapter rapidement \u00e0 cette nouvelle r\u00e9alit\u00e9, tout comme la plupart des autres pays europ\u00e9ens. Il va falloir instaurer un meilleur \u00e9quilibre entre la protection sociale des travailleurs et les besoins de l\u2019\u00e9conomie actuelle en termes de flexibilit\u00e9 et d\u2019autonomie. PwC Legal a analys\u00e9 les l\u00e9gislations sociales en mati\u00e8re de gig economy dans dix pays europ\u00e9ens occidentaux. <em>\u201cNotre pays pourrait jouer un r\u00f4le de pionnier en Europe,\u201d<\/em> estime PwC Legal.<\/p>\n<p>La gig economy a vu le jour, notamment en raison des nombreuses possibilit\u00e9s qu\u2019offrent les nouvelles technologies comme le GPS, l\u2019internet mobile et les smartphones, qui permettent d\u00e9sormais de commander et de livrer des services \u00e0 la vitesse de l\u2019\u00e9clair et d\u2019impliquer des op\u00e9rateurs dans le cycle \u00e0 leur meilleure convenance. Avec toute la controverse que cela suscite. Les entreprises comme Uber, Deliveroo et Amazon sont lou\u00e9es par certains et maudites par d\u2019autres, en raison de leur mode de travail atypique et r\u00e9volutionnaire. La grande incertitude qui plane autour des travailleurs actifs au sein de la gig economy est l\u2019une des principales raisons de cette controverse. Cette incertitude touche avant tout le droit du travail et les garanties sociales. Ces travailleurs doivent-ils \u00eatre consid\u00e9r\u00e9s comme ind\u00e9pendants ou plut\u00f4t comme travailleurs classiques\u2009? Aucun de ces statuts ne leur correspond v\u00e9ritablement. Pour faire le bilan, PwC Legal a analys\u00e9 la situation actuelle dans dix pays europ\u00e9ens, dont la Belgique.<\/p>\n<p>Comme la Belgique, la plupart des pays font la distinction entre ces deux statuts, \u00e0 savoir le statut de travailleur salari\u00e9 et le statut d\u2019ind\u00e9pendant. La principale diff\u00e9rence entre ces deux statuts r\u00e9side dans la mesure o\u00f9 la plateforme exerce une quelconque autorit\u00e9 sur le travailleur. Soulignons toutefois que, dans trois pays (Italie, Espagne et Royaume-Uni), il existe un troisi\u00e8me statut qui allie une sorte de protection sociale \u00e0 une plus grande flexibilit\u00e9. Mais ces pays sont, eux aussi, confront\u00e9s \u00e0 diff\u00e9rents probl\u00e8mes. L\u2019Europe a incit\u00e9 ses \u00c9tats membres, en 2016, \u00e0 harmoniser davantage leur l\u00e9gislation sociale par rapport \u00e0 cette nouvelle r\u00e9alit\u00e9, mais les r\u00e9sultats sont peu convaincants, y compris en Belgique.<\/p>\n<p><strong><em>S\u00e9curit\u00e9 juridique, transparence et flexibilit\u00e9<\/em><\/strong><\/p>\n<p><em>\u201cAucun statut actuel ne r\u00e9pond aux besoins de la gig economy\u201d<\/em> explique Pascale Moreau, Partner, PwC Legal. <em>\u201cEn t\u00e9moignent les nombreux dossiers judiciaires en cours dans la plupart des pays que nous avons analys\u00e9s, qui remettent en question le statut des travailleurs de la gig economy. Nous devons oser repenser profond\u00e9ment le cadre du droit du travail afin de trouver un bon \u00e9quilibre entre la protection sociale et les besoins de l\u2019\u00e9conomie actuelle. La s\u00e9curit\u00e9 juridique, la transparence et la flexibilit\u00e9 doivent \u00eatre les piliers d\u2019un nouveau droit du travail. L\u2019exercice consistera \u00e0 d\u00e9finir un cadre l\u00e9gal ad\u00e9quat, sans compliquer davantage inutilement notre droit du travail.\u201d<\/em><\/p>\n<p>Jessica De Bels, Avocat en droit social chez PwC Legal, ajoute que la Belgique est tout \u00e0 fait capable de proposer un plan : <em>\u201cCes changements constituent un \u00e9norme d\u00e9fi de capacit\u00e9 d\u2019adaptation du cadre l\u00e9gal belge. Il incombe aux pouvoirs publics de faire preuve de r\u00e9activit\u00e9 et de relever adroitement tous les d\u00e9fis de la gig economy. La Belgique a la possibilit\u00e9 de jouer un r\u00f4le de pionnier qui permettra \u00e0 la gig economy et \u00e0 ses travailleurs de se d\u00e9velopper pleinement.
