La question se pose fr\u00e9quemment dans les cas de licenciement: faut-il inclure le bonus dans l\u2019indemnit\u00e9 compensatoire de pr\u00e9avis? Un r\u00e9cent arr\u00eat de la Cour de Cassation r\u00e9pond \u00e0 cette interrogation.<!--more--><\/p>\n<p>Le calcul de l\u2019indemnit\u00e9 compensatoire de pr\u00e9avis ne prend pas uniquement en compte la r\u00e9mun\u00e9ration en cours, mais \u00e9galement les avantages acquis en vertu du contrat. Il n\u2019y a pas que la r\u00e9mun\u00e9ration fixe qui tombe sous le concept de r\u00e9mun\u00e9ration en cours mais \u00e9galement la r\u00e9mun\u00e9ration variable, telle qu\u2019un bonus auquel avait droit le travailleur au moment du licenciement.<\/p>\n<p>Depuis le Statut Unique, la loi \u00e9nonce express\u00e9ment que lorsque la r\u00e9mun\u00e9ration en cours ou les avantages acquis en vertu du contrat sont partiellement ou enti\u00e8rement variables, on prend en compte, pour la partie variable, la moyenne des douze mois ant\u00e9rieurs ou, le cas \u00e9ch\u00e9ant, la partie de ces douze mois au cours de laquelle le travailleur a \u00e9t\u00e9 en service.<\/p>\n<p>La Cour de Cassation pr\u00e9cise, dans un arr\u00eat du 6 mai 2019, que cette disposition \u00e9tablit une r\u00e8gle pour le calcul de la r\u00e9mun\u00e9ration variable au moment du licenciement. Elle n\u2019a au contraire pas pour effet que chaque avantage variable pay\u00e9 dans les douze mois ant\u00e9rieurs au licenciement fait partie de la r\u00e9mun\u00e9ration en cours au moment du licenciement.<\/p>\n<p>De ce m\u00eame arr\u00eat, la Cour devait se prononcer sur la question de savoir si un bonus devait \u00eatre repris dans l\u2019indemnit\u00e9 compensatoire de pr\u00e9avis, dans le cas sp\u00e9cifique o\u00f9 :<\/p>\n<ul>\n<li>un bonus avait effectivement \u00e9t\u00e9 octroy\u00e9 l\u2019ann\u00e9e pr\u00e9c\u00e9dant le licenciement,<\/li>\n<li>il \u00e9tait pr\u00e9vu dans le contrat de travail que l\u2019octroi du bonus pour une ann\u00e9e sp\u00e9cifique n\u2019ouvre pas un droit \u00e0 un bonus pour les ann\u00e9es suivantes, et<\/li>\n<li>l\u2019employeur, au moment du licenciement, n\u2019avait pas encore manifest\u00e9 sa d\u00e9cision de ne pas octroyer de bonus pour l\u2019ann\u00e9e en cours.<\/li>\n<\/ul>\n<p>La Cour estime que les faits sont importants. La Cour a estim\u00e9, dans ce cas sp\u00e9cifique, que le travailleur n\u2019avait pas droit \u00e0 un bonus. A cet \u00e9gard, la Cour a tenu compte :<\/p>\n<ul>\n<li>de la r\u00e9serve \u00e9nonc\u00e9e dans le contrat de travail concernant l\u2019octroi r\u00e9p\u00e9t\u00e9 du bonus,<\/li>\n<li>des tr\u00e8s mauvais r\u00e9sultats \u00e9conomiques de l\u2019entreprise pour l\u2019ann\u00e9e durant laquelle il a \u00e9t\u00e9 proc\u00e9d\u00e9 au licenciement,<\/li>\n<li>du fait qu\u2019aucun des cadres (cat\u00e9gorie \u00e0 laquelle appartenait le travailleur licenci\u00e9) n\u2019avait re\u00e7u un bonus, et ce m\u00eame apr\u00e8s le licenciement en question.<\/li>\n<\/ul>\n<p>Le fait que l\u2019employeur n\u2019avait pas encore communiqu\u00e9 au cadre, au moment du licenciement, qu\u2019aucun bonus ne serait octroy\u00e9 pour cette ann\u00e9e n\u2019est pas pertinent selon la Cour.<\/p>\n<p>Le cabinet Lydian recommande d\u00e8s lors de v\u00e9rifier\u00a0la formulation\u00a0de vos plans de bonus et de veiller\u00a0\u00e0 ce qu&rsquo;y figureune r\u00e9serve satisfaisante en ce qui concerne l\u2019octroi r\u00e9p\u00e9t\u00e9 du bonus, afin de b\u00e9n\u00e9ficier d&rsquo;une marge de manoeuvre pour ne pas octroyer un bonus pour certaines ann\u00e9es.<\/p>\n<p><em>Source: Lydian<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>R\u00e9vision de jurisprudence int\u00e9ressante propos\u00e9e par le Cabinet d&rsquo;avocats Lydian.
