Federgon souhaite toutefois mettre en \u00e9vidence les risques li\u00e9s \u00e0 la mise en oeuvre d&rsquo;une politique RH inclusive vis-\u00e0-vis des prestataires externes et promouvoir de la sorte son label de qualit\u00e9 Projectsourcing.<!--more--><\/p>\n<p><em>\u00ab\u00a0Une politique RH sur mesure pour les collaborateurs externes peut causer des probl\u00e8mes sur le plan du droit du travail\u00a0\u00bb,<\/em> selon Federgon.<\/p>\n<p><em>\u00ab\u00a0Actuellement, de plus en plus d\u2019entreprises font en effet appel \u00e0 des collaborateurs externes. Il s\u2019agit souvent de collaborateurs ind\u00e9pendants, mais cela peut aussi \u00eatre des professionnels externes qui sont les employ\u00e9s de bureaux de projectsourcing sp\u00e9cialis\u00e9s. Les bureaux de projectsourcing sont des bureaux qui fournissent \u00e0 leurs clients des sp\u00e9cialistes pour la r\u00e9alisation d\u2019un projet pr\u00e9cis dans divers domaines : IT, HR, Engineering, Finance, etc. Ces sp\u00e9cialistes externes, les collaborateurs de projet, peuvent \u00eatre affect\u00e9s \u00e0 des missions de courte ou de longue dur\u00e9e, sur site ou hors site. La flexibilit\u00e9 propre au projectsourcing rend la formule tr\u00e8s attractive pour les entreprises. Mais comment les entreprises doivent-elles g\u00e9rer ces collaborateurs externes?\u00a0\u00bb<\/em><\/p>\n<p>La F\u00e9d\u00e9ration du secteur RH rappelle : <em>\u00ab\u00a0du c\u00f4t\u00e9 des entreprises, la tentation est grande de concevoir une politique RH aussi pour les collaborateurs de projet, afin de permettre \u00e0 ceux-ci de s\u2019int\u00e9grer au maximum dans l\u2019entreprise. C\u2019est l\u00e0 justement que r\u00e9side le risque sur le plan du droit du travail. Dans le cadre du projectsourcing, il est en effet tr\u00e8s important de pouvoir d\u00e9montrer que le bureau de projectsourcing exerce l\u2019autorit\u00e9 patronale et donne des instructions \u00e0 ses collaborateurs pour mener le projet \u00e0 bonne fin.\u00a0L\u2019entreprise cliente, en revanche, ne peut pas donner des instructions aux collaborateurs de projet, sauf si celles-ci ont trait \u00e0 la s\u00e9curit\u00e9 ou si elles sont consign\u00e9es dans un contrat clair. Toutes les autres instructions sont bannies. S\u2019il appara\u00eet lors d\u2019une inspection que l\u2019entreprise cliente exerce tout de m\u00eame l\u2019autorit\u00e9 patronale, il y a des risques de sanctions, comme par exemple des amendes ou l\u2019apparition automatique d\u2019un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e entre l\u2019entreprise et le collaborateur de projet, ce qui n\u2019est bien s\u00fbr pas le but. Bref, lorsque la politique RH \u00e0 l\u2019\u00e9gard de ces collaborateurs externes que sont les collaborateurs de projet est prise en charge par la partie qui n\u2019est pas comp\u00e9tente en la mati\u00e8re, cela n\u2019est pas sans risque.\u00a0\u00bb<\/em><\/p>\n<p>Il faut donc veiller \u00e0 respecter le cadre juridique du projectsourcing. Federgon insiste: <em>\u00ab\u00a0un bureau de projectsourcing professionnel veille \u00e0 ce que ses collaborateurs de projet se sentent bien dans votre entreprise, sans risque sur le droit du travail par ailleurs et sans que vous deviez assumer l\u2019ensemble de la politique RH. Les bureaux de projectsourcing investissent de mani\u00e8re tr\u00e8s intensive dans leur personnel ; ils organisent des teambuildings, des r\u00e9unions, des briefings, \u2026 Certains d\u2019entre eux ont m\u00eame leur propre academy pour former leurs collaborateurs dans les diff\u00e9rents domaines d\u2019expertise dans lesquels ils sont actifs. En d\u2019autres termes, le bureau de projectsourcing est un employeur tr\u00e8s impliqu\u00e9.\u00a0\u00bb<\/em><\/p>\n<p><strong><em>Le label de qualit\u00e9 projectsourcing \u00a0veut offrir des garanties aux entreprises.<\/em><\/strong><\/p>\n<p><em>\u00ab\u00a0Comment choisir le bureau de projectsourcing ad\u00e9quat ?
