Lorsqu\u2019elle est affect\u00e9e \u00e0 un autre poste qui n\u2019est pas \u00e9quivalent, il y a pr\u00e9somption de discrimination fond\u00e9e sur le sexe. C\u2019est le jugement rendu par le tribunal du travail de Bruxelles dans le cadre d\u2019une affaire pour laquelle l\u2019Institut pour l&rsquo;\u00e9galit\u00e9 des femmes et des hommes a saisi la justice.<!--more--><\/p>\n<p>En 2016, une travailleuse d\u2019une grande entreprise a pris un cong\u00e9 de maternit\u00e9, suivi d\u2019un cong\u00e9 parental. Quelques mois auparavant, elle avait re\u00e7u une \u00e9valuation tr\u00e8s positive ainsi qu\u2019une augmentation salariale. \u00c0 son retour, elle a \u00e9t\u00e9 inform\u00e9e de la r\u00e9organisation de son service et il est apparu clairement qu\u2019elle avait \u00e9t\u00e9 r\u00e9trograd\u00e9e. La travailleuse a perdu sa fonction dirigeante, s\u2019est vu confier des t\u00e2ches d\u2019ex\u00e9cution en lieu et place de ses t\u00e2ches de coordination, et ne rendait plus directement compte au directeur. Elle a port\u00e9 plainte aupr\u00e8s de l\u2019Institut pour l\u2019\u00e9galit\u00e9 des hommes et des femmes et a d\u00e9missionn\u00e9. L\u2019Institut s\u2019est associ\u00e9 \u00e0 la travailleuse afin de porter l\u2019affaire en justice.<\/p>\n<p>Le 3 septembre 2019, le tribunal du travail a d\u00e9cid\u00e9 qu\u2019une femme ayant pris un cong\u00e9 de maternit\u00e9 ne peut \u00eatre r\u00e9trograd\u00e9e \u00e0 son retour au travail. Selon le tribunal, il y a pr\u00e9somption de discrimination fond\u00e9e sur le sexe et de discrimination li\u00e9e \u00e0 la grossesse lorsqu\u2019une femme ne peut retrouver le m\u00eame poste ou un poste \u00e9quivalent. L\u2019employeur n\u2019ayant pas r\u00e9ussi \u00e0 renverser la pr\u00e9somption, l\u2019entreprise a \u00e9t\u00e9 condamn\u00e9e \u00e0 lui verser six mois de salaire brut (32.000 euros) de dommages et int\u00e9r\u00eats. L\u2019Institut recevra quant \u00e0 lui un euro \u00e0 titre de pr\u00e9judice moral.<\/p>\n<p>La grossesse et la maternit\u00e9 sont deux des crit\u00e8res prot\u00e9g\u00e9s pour lesquels l\u2019Institut est comp\u00e9tent. La discrimination \u00e0 l\u2019\u00e9gard des femmes enceintes et des m\u00e8res reste un probl\u00e8me soci\u00e9tal majeur. En 2018, parmi les signalements re\u00e7us par l\u2019Institut, un sur cinq portait sur cette th\u00e9matique. <em>\u00ab La grossesse, la maternit\u00e9 et la parentalit\u00e9 sont des phases normales dans la carri\u00e8re professionnelle qui ne peuvent d\u00e8s lors pas avoir d&rsquo;impact sur la carri\u00e8re des travailleur-se-s. Ce jugement montre qu\u2019\u00e0 son retour de cong\u00e9 de maternit\u00e9, une femme a droit aux m\u00eames conditions de travail et aux m\u00eames conditions de vie au travail. Sans cette s\u00e9curit\u00e9, les travailleuses enceintes se retrouvent dans une situation tr\u00e8s vuln\u00e9rable \u00bb<\/em>, explique Michel Pasteel, le directeur de l\u2019Institut.<\/p>\n<p>M\u00eame lorsqu\u2019une r\u00e9organisation a lieu pendant cette absence, ou lorsque l\u2019employeur est satisfait du\/de la rempla\u00e7ant-e de la travailleuse enceinte, les travailleuses qui reprennent le travail \u00e0 l&rsquo;issue de leur cong\u00e9 de maternit\u00e9 ont droit \u00e0 une fonction \u00e9quivalente.
