Et depuis lors, les entreprises m\u00e8nent de laborieuses proc\u00e9dures lorsque des plans de restructurations s\u2019av\u00e8rent in\u00e9vitables.<br \/>\nLa FEB insiste sur la philosophie protectrice et passive de la loi qui rend le processus encore plus lourd. Pour r\u00e9pondre aux besoins constat\u00e9s sur le terrain, les partenaires sociaux du Conseil National du Travail (CNT) se sont r\u00e9unis et, pour la premi\u00e8re fois, se sont mis d\u2019accord pour formuler ensemble plusieurs recommandations \u00e0 l\u2019attention des repr\u00e9sentants patronaux et syndicaux au sein des entreprises et des secteurs. <!--more--><\/p>\n<p><em>\u00ab\u00a0Plut\u00f4t que de se concentrer prioritairement sur l\u2019activation et la mise \u00e0 jour des comp\u00e9tences des travailleurs pour regarder vers l\u2019avenir, la loi actuelle ne pr\u00e9voit aucune limite dans le temps \u00e0 la phase dite d\u2019information-consultation. Cette situation peut entrainer des proc\u00e9dures inutilement longues, souvent pour un maigre r\u00e9sultat \u2026 et qui a, la plupart du temps, pour seul effet de retarder l\u2019in\u00e9luctable,\u00a0\u00bb <\/em>comme le pr\u00e9cise la f\u00e9d\u00e9ration patronale.<\/p>\n<p><em><strong>Fixer un calendrier et regarder vers l\u2019avenir<\/strong><\/em><\/p>\n<p>La toute premi\u00e8re recommandation consiste \u00e0 fixer un timing clair pour permettre une information-consultation \u00e0 la fois qualitative et limit\u00e9e dans le temps. Ce faisant, les repr\u00e9sentants syndicaux et patronaux s\u2019engagent notamment \u00e0 respecter l\u2019ordre du jour des r\u00e9unions et \u00e0 d\u00e9terminer ensemble les modalit\u00e9s de transmission des questions et r\u00e9ponses. Dans ce timing, ils peuvent aussi fixer les modalit\u00e9s d\u2019appel \u00e0 des tiers ou des experts. La fixation d&rsquo;un calendrier entre les repr\u00e9sentants vise de cette mani\u00e8re \u00e0 rendre la proc\u00e9dure plus efficace.<\/p>\n<p>Les partenaires sociaux veulent par ailleurs souligner la priorit\u00e9 de l\u2019emploi en g\u00e9n\u00e9ral et la relance de l\u2019activit\u00e9. La sauvegarde de l\u2019emploi existant n\u2019est pas le seul crit\u00e8re de succ\u00e8s d\u2019une restructuration. Ce qui importe avant tout, c\u2019est l\u2019avenir et les opportunit\u00e9s qu\u2019il r\u00e9serve. Cette recommandation s\u2019inscrit \u00e0 la fois dans l\u2019objectif g\u00e9n\u00e9ral d\u2019am\u00e9lioration du taux d\u2019emploi et d\u2019employabilit\u00e9 des travailleurs et dans l\u2019objectif de consolidation de la sant\u00e9 \u00e9conomique de l\u2019entreprise en restructuration.<\/p>\n<p><em><strong>Lister et informer les co-contractants impact\u00e9s significativement et n\u00e9gativement<\/strong><\/em><\/p>\n<p>Les restructurations peuvent enfin impliquer d\u2019autres acteurs du cycle \u00e9conomique que les entreprises elles-m\u00eames. Les effets \u201ccascade\u201d d\u00e9favorables pour leurs co-contractants font aussi partie des al\u00e9as. D\u00e8s lors les partenaires sociaux recommandent aux entreprises d\u2019identifier ceux, parmi leurs co-contractants, pour lesquels la restructuration a un impact \u00e0 la fois significatif et n\u00e9gatif. Ceux-ci seront inform\u00e9s, soit en m\u00eame temps, soit imm\u00e9diatement apr\u00e8s l\u2019annonce de l\u2019intention de licenciement, \u00e0 la condition que les obligations contractuelles de l\u2019entreprise en restructuration soient modifi\u00e9es \u00e0 leur \u00e9gard. Des personnes de contact en interne seront d\u00e9sign\u00e9es pour que les co-contractants puissent examiner les cons\u00e9quences \u00e9ventuelles du projet de restructuration et pour qu\u2019ils puissent, \u00e0 leur tour, informer eux-m\u00eames leurs propres organes ou travailleurs. Cette recommandation avalise les pratiques que, d\u00e9j\u00e0 sur le terrain, de nombreuses entreprises en restructurations ont coutume d\u2019appliquer.<\/p>\n<p><em><strong>Am\u00e9liorer et simplifier les \u00e9changes d\u2019information<\/strong><\/em><\/p>\n<p>Enfin, les partenaires sociaux se sont aussi entendus pour proposer, dans une phase ult\u00e9rieure, une centralisation des textes r\u00e9glementaires relatifs aux restructurations dans un avis unanime au CNT.
