L&rsquo;approche n&rsquo;est pas punitive. Les partenaires sociaux ont poursuivi l&rsquo;objectif commun de pr\u00e9venir les difficult\u00e9s et les accidents. Comme le rappelle l&rsquo;UCM, la consommation d&rsquo;alcool est en principe interdite pendant les heures de travail, mais elle ne l&rsquo;est pas totalement dans l&rsquo;entreprise. Pour un salari\u00e9, l&rsquo;ivresse elle-m\u00eame n&rsquo;est pas punissable. Les cons\u00e9quences peuvent l&rsquo;\u00eatre.<!--more--><\/p>\n<p>Dans un souci de clart\u00e9, la politique de l&rsquo;entreprise doit d&rsquo;ailleurs \u00eatre pr\u00e9cis\u00e9e dans le r\u00e8glement de travail.\u00a0La convention autorise la consommation d&rsquo;alcool dans les entreprises, mais uniquement en dehors des heures de service, avec l&rsquo;accord de l&#8217;employeur. Celui-ci ne peut pas se m\u00ealer du comportement de ses salari\u00e9s lorsqu&rsquo;ils ne sont pas au boulot, y compris sur le temps de midi. Il peut proposer un test d&rsquo;haleine si c&rsquo;est pr\u00e9vu dans le r\u00e8glement de travail, mais il ne peut pas l&rsquo;imposer.<\/p>\n<p>L&#8217;employeur ne peut d&rsquo;ailleurs pas sanctionner un salari\u00e9 ou un ouvrier pour ivresse, mais bien en fonction des cons\u00e9quences. Si par exemple un travailleur prend ou veut prendre le volant d&rsquo;un bus, d&rsquo;un camion ou d&rsquo;un engin de chantier et met ainsi sa vie et celle des autres en danger, cela peut justifier un licenciement pour faute grave. Si la personne n&rsquo;est pas en \u00e9tat d&rsquo;effectuer sa t\u00e2che correctement ou perturbe ses coll\u00e8gues, cela peut donner lieu \u00e0 un avertissement \u00e9crit. Selon l&rsquo;usage, trois avertissements risquent d&rsquo;entra\u00eener un licenciement.<\/p>\n<p>En cas de f\u00eate dans l&rsquo;entreprise (Nouvel An, prise de pension, gros contrat d\u00e9croch\u00e9\u2026), l&#8217;employeur a des responsabilit\u00e9s, peu importe qu&rsquo;il propose lui-m\u00eame de l&rsquo;alcool ou le tol\u00e8re. Le trajet du retour reste en effet consid\u00e9r\u00e9 comme \u00ab\u00a0chemin du travail\u00a0\u00bb. En cas d&rsquo;accident, c&rsquo;est donc l&rsquo;assurance de l&#8217;employeur qui interviendra. Elle pourrait se retourner contre lui s&rsquo;il n&rsquo;a pas veill\u00e9 \u00e0 la s\u00e9curit\u00e9 de ses salari\u00e9s. Dans la pratique, le risque est faible, mais la prise en compte du retour en voiture est l&rsquo;esprit de la convention de 2009.\u00a0Pour l&rsquo;UCM, le bilan de cet accord est positif.
