Il s&rsquo;agit de prot\u00e9ger nos entreprises des impacts n\u00e9gatifs qui pourraient survenir en cas de non accord avec le Royaume Uni d\u00e9sormais sorti de l&rsquo;Union europ\u00e9enne.<!--more--><\/p>\n<p>Les mesures temporaires de cette loi sur le Brexit ont pour principal objectif d\u2019\u00e9viter ou de limiter la perte d\u2019emplois. Monica De Jonghe, directeur g\u00e9n\u00e9ral de la F\u00e9d\u00e9ration des entreprises de Belgique (FEB), d\u00e9clare : <em>\u00ab Nous nous r\u00e9jouissons que les mesures propos\u00e9es nous pr\u00e9parent \u00e0 tous les sc\u00e9narios possibles, car l\u2019avenir de l\u2019emploi dans notre pays en d\u00e9pend en partie. \u00bb<\/em><\/p>\n<p>Les entreprises ont ainsi le temps de se r\u00e9tablir et, le cas \u00e9ch\u00e9ant, de chercher des d\u00e9bouch\u00e9s de remplacement. La proposition de loi contient un crit\u00e8re clair et \u00e9quitable pour la reconnaissance des entreprises en difficult\u00e9s : une baisse d\u2019au moins 5% de leur chiffre d\u2019affaires, de leur production ou de leurs commandes. Cette reconnaissance peut \u00e9galement valoir pour une entit\u00e9 d\u2019une entreprise. La FEB d\u00e9plore toutefois qu\u2019un amendement ait emp\u00each\u00e9 la simplification de la proc\u00e9dure de reconnaissance. Le syst\u00e8me extr\u00eamement lourd de concertation sociale en cascade, en vigueur avant les mesures de crise de 2009, a \u00e9t\u00e9 simplifi\u00e9 par le biais d\u2019une demande de reconnaissance unique sans qu\u2019il soit n\u00e9cessaire d\u2019\u00e9tablir un plan d\u2019entreprise. En soi, c\u2019est une bonne chose, mais la FEB aurait pr\u00e9f\u00e9r\u00e9 que ce syst\u00e8me en cascade soit abandonn\u00e9. En effet, il ne fait qu\u2019entra\u00eener des obligations administratives additionnelles pour les entreprises qui subissent d\u00e9j\u00e0 une perte de leur chiffre d\u2019affaires.<\/p>\n<p>Cette proposition de loi n\u2019entrerait en vigueur qu\u2019en cas de \u2018no deal Brexit\u2019. Les dispositions r\u00e9gissant son entr\u00e9e en vigueur peuvent \u00eatre modifi\u00e9es si n\u00e9cessaire ou en l\u2019absence d\u2019accord futur de libre-\u00e9change d\u2019ici au 31 d\u00e9cembre 2020.<\/p>\n<p>Apr\u00e8s approbation, les entreprises reconnues en difficult\u00e9s pourront b\u00e9n\u00e9ficier de trois mesures temporaires : un syst\u00e8me additionnel de ch\u00f4mage temporaire pour les ouvriers et les employeurs s\u2019ajoutant au syst\u00e8me g\u00e9n\u00e9ral qui reste d\u2019application, le cr\u00e9dit-temps et la r\u00e9duction du temps de travail.<\/p>\n<p><em>\u00ab La loi sur le Brexit reprend en grande partie les mesures de crise de 2009-2011, ainsi que les mesures adopt\u00e9es \u00e0 la suite des attentats de 2016. N\u00e9anmoins, la n\u00e9cessit\u00e9 de conclure une CCT d\u2019entreprise est une perte de temps, alors que l\u2019objectif de ces mesures de soutien consiste pr\u00e9cis\u00e9ment \u00e0 limiter la perte au niveau de l\u2019emploi priv\u00e9.
