La Cour a estim\u00e9 que la victime avait \u00e9t\u00e9 discrimin\u00e9e en raison entre autres de sa fausse couche. Apr\u00e8s avoir vainement essay\u00e9 de trouver une solution \u00e0 l\u2019amiable, l\u2019Institut pour l\u2019\u00e9galit\u00e9 entre les femmes et les hommes et le syndicat de la plaignante avaient introduit l\u2019affaire en justice.<!--more--><\/p>\n<p>La plaignante avait subi une fausse couche. Elle avait remis un certificat m\u00e9dical \u00e0 son employeur et l\u2019avait inform\u00e9 du motif de son absence. L\u2019employeur avait imm\u00e9diatement fait part de son intention de la licencier et l\u2019a effectivement licenci\u00e9e peu de temps apr\u00e8s par courrier.<\/p>\n<p>Comme le rappelle Michel Pasteel, directeur de l\u2019Institut : <em>\u00ab Aujourd\u2019hui encore, en 2020, des travailleuses enceintes continuent de subir des discriminations parce qu\u2019elles sont des femmes et qu\u2019elles sont enceintes. Cette situation est et demeure intol\u00e9rable. En particulier en ces temps incertains de corona, les femmes restent vuln\u00e9rables \u00e0 ce type de discrimination.\u00bb<\/em><\/p>\n<p>La Cour a rappel\u00e9 qu\u2019une femme qui est victime d\u2019une fausse couche et qui n\u2019est donc plus enceinte b\u00e9n\u00e9ficie de la protection anti-discrimination fond\u00e9e sur le sexe. La (le d\u00e9sir de) maternit\u00e9, en ce compris le fait de subir une fausse couche et de subir une incapacit\u00e9 de travail r\u00e9sultant de cette fausse couche est une r\u00e9alit\u00e9 physique qui ne concerne que les femmes. Par cons\u00e9quent, le licenciement intervenant en raison de la maternit\u00e9 d\u2019une travailleuse, de son d\u00e9sir de maternit\u00e9, de son \u00e9tat de grossesse, de la fausse couche qu\u2019elle a subie ou de l\u2019incapacit\u00e9 de travail r\u00e9sultant de cette fausse couche constitue une discrimination directe sur la base du sexe.<\/p>\n<p>L\u2019ex-employeur a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer une indemnit\u00e9 \u00e9quivalente \u00e0 6 mois de r\u00e9mun\u00e9ration brute \u00e0 la plaignante et 1\u20ac symbolique \u00e0 l\u2019Institut.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Source : Institut pour l&rsquo;\u00e9galit\u00e9 des femmes et des hommes<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour du travail de Li\u00e8ge a condamn\u00e9 le 21 f\u00e9vrier 2020 dernier un employeur pour un licenciement discriminatoire.
