









{"id":9802,"date":"2020-06-29T07:58:42","date_gmt":"2020-06-29T05:58:42","guid":{"rendered":"https:\/\/peoplesphere.be\/fr\/?p=9802"},"modified":"2020-06-29T07:58:42","modified_gmt":"2020-06-29T05:58:42","slug":"transparence-salariale-garante-de-legalite-genres-nest-inscrite-legislation-belge","status":"publish","type":"post","link":"https:\/\/peoplesphere.be\/fr\/transparence-salariale-garante-de-legalite-genres-nest-inscrite-legislation-belge\/","title":{"rendered":"La transparence salariale, garante de l&rsquo;\u00e9galit\u00e9 des genres, n&rsquo;est pas inscrite dans la l\u00e9gislation belge."},"content":{"rendered":"<p>La Belgique viole deux articles de la Charte sociale europ\u00e9enne en n&rsquo;assurant pas la transparence salariale, pourtant d\u00e9terminante dans l&rsquo;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration pour un travail de valeur \u00e9gale entre les sexes, affirme ce lundi l&rsquo;organe du Conseil de l&rsquo;Europe charg\u00e9 de la mise en \u0153uvre de cette charte.<!--more--><\/p>\n<p>En Belgique, la loi du 22 avril 2012 de lutte contre l&rsquo;\u00e9cart de r\u00e9mun\u00e9ration entre les femmes et les hommes a permis d&rsquo;accro\u00eetre la visibilit\u00e9 de cet \u00e9cart et s&rsquo;est r\u00e9v\u00e9l\u00e9e utile pour le r\u00e9duire, reconna\u00eet le Comit\u00e9 europ\u00e9en des droits sociaux (CEDS), dans des rapports balayant la situation dans 15 \u00c9tats.<br \/>\nMais le principe de transparence salariale n&rsquo;est pas consacr\u00e9 dans la l\u00e9gislation belge et le pays n&rsquo;a pas encore pris les mesures n\u00e9cessaires pour int\u00e9grer une recommandation de la Commission europ\u00e9enne de 2014 en ce sens, fait-il observer en r\u00e9ponse \u00e0 des plaintes de l&rsquo;ONG internationale University Women Europe (UWE).<\/p>\n<p>Le Comit\u00e9 ajoute que la l\u00e9gislation actuelle ne fixe pas de param\u00e8tres pour \u00e9tablir la valeur \u00e9gale du travail effectu\u00e9, tels que la nature du travail, la formation et les conditions de travail. Il existe bien une \u00e9valuation \u00e0 grande \u00e9chelle des classifications des fonctions quant \u00e0 leur neutralit\u00e9 en mati\u00e8re de genre, ainsi qu&rsquo;une v\u00e9rification par l&rsquo;Inspection du travail (SPF Emploi), mais il n&rsquo;y a ni obligation l\u00e9gale de modifier ces classifications lorsqu&rsquo;elles ne passent pas le test de la neutralit\u00e9 de genre ni de v\u00e9ritable sanction si elles ne sont pas modifi\u00e9es, expose le CEDS.\u00a0Citant d&rsquo;autres lacunes, il consid\u00e8re que l&rsquo;obligation de reconna\u00eetre et de respecter le principe de transparence salariale dans la pratique n&rsquo;est donc pas respect\u00e9e en Belgique. En revanche, le Comit\u00e9 n&rsquo;a pas constat\u00e9 de violation de la Charte par la Belgique pour la reconnaissance du droit \u00e0 l&rsquo;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration dans la l\u00e9gislation, pour l&rsquo;acc\u00e8s \u00e0 des recours effectifs ni en ce qui concerne les organes d&rsquo;\u00e9galit\u00e9.<\/p>\n<p>La Charte est \u00e9galement respect\u00e9e par la Belgique pour la promotion de l&rsquo;\u00e9galit\u00e9 des chances entre les femmes et les hommes en mati\u00e8re salariale, ainsi que pour la repr\u00e9sentation \u00e9quilibr\u00e9e des femmes dans les postes d\u00e9cisionnels au sein des entreprises priv\u00e9es, selon le CEDS.<br \/>\nLa Su\u00e8de est le seul des 15 pays examin\u00e9s \u00e0 remplir les crit\u00e8res de la Charte dans tous ces domaines, les pays d\u00e9faillants \u00e9tant la Belgique, la Bulgarie, la Croatie, la R\u00e9publique tch\u00e8que, Chypre, la Finlande, la France, la Gr\u00e8ce, l&rsquo;Irlande, l&rsquo;Italie, les Pays-Bas, la Norv\u00e8ge, le Portugal et la Slov\u00e9nie.<\/p>\n<p><em>\u00ab\u00a0Malgr\u00e9 l&rsquo;instauration de quotas et d&rsquo;autres mesures, les femmes continuent d&rsquo;\u00eatre sous-repr\u00e9sent\u00e9es aux postes d&rsquo;encadrement dans les entreprises du secteur priv\u00e9.
