Alors que la question d\u2019une plus juste r\u00e9mun\u00e9ration d\u2019un certain nombre de fonctions a refait surface avec la crise du Covid-19, ne serait-il pas aussi temps de remettre au centre de la r\u00e9flexion le principe d\u2019un salaire \u00e9gal pour un emploi de valeur comparable?\u00a0Bernard Keppenne, Chief Economist CBC Banque, nous propose une carte blanche consacr\u00e9e \u00e0 cette th\u00e9matique cl\u00e9 pour le futur.<!--more--><\/p>\n<p>Le CEDS\u00a0pointe\u00a0dans sa communication du 29 juin dernier <em> \u00ab\u00a0l\u2019insuffisance de progr\u00e8s en vue de r\u00e9duire l\u2019\u00e9cart de r\u00e9mun\u00e9ration entre les hommes et les femmes, le manque de transparence sur le march\u00e9 du travail, l\u2019absence de voies de recours effectives ou le manque de pouvoirs et de ressources des organismes nationaux de promotion de l\u2019\u00e9galit\u00e9 hommes-femmes\u00a0\u00bb<\/em>.<\/p>\n<p>Pour aller au-del\u00e0 des arguments avanc\u00e9s jusqu\u2019\u00e0 pr\u00e9sent pour \u00ab justifier \u00bb cet \u00e9cart salarial, le principe d\u2019un salaire \u00e9gal pour un travail de valeur comparable propose de d\u00e9passer la question de la s\u00e9gr\u00e9gation professionnelle, les salaires des hommes et des femmes devant \u00eatre \u00e9gaux \u00e0 la fois pour un emploi identique mais \u00e9galement pour un emploi diff\u00e9rent ayant une valeur comparable.<\/p>\n<p>Car il ressort clairement qu\u2019un taux \u00e9lev\u00e9 de f\u00e9minisation d\u2019un secteur ou d\u2019une cat\u00e9gorie d\u2019emploi va de pair avec des salaires plus faibles et qu\u2019il faut donc casser ce m\u00e9canisme qui entraine une sous-valorisation de certaines fonctions (comme les infirmi\u00e8res, les pu\u00e9ricultrices,&#8230;). Ce qui permettrait non seulement d\u2019\u00e9viter que la f\u00e9minisation de certains m\u00e9tiers n\u2019entraine une d\u00e9valorisation de ceux-ci et aussi de contribuer \u00e0 une \u00e9galit\u00e9 de r\u00e9mun\u00e9ration de salaires dans toutes les fonctions.<\/p>\n<p>Ce qui est interpellant c\u2019est que la Belgique, mais les autres pays aussi, s\u2019est dot\u00e9e d\u2019une l\u00e9gislation reconnaissant le droit \u00e0 un salaire \u00e9gal pour un travail \u00e9gal, ou un travail de valeur \u00e9gale.<\/p>\n<p><em><strong>Comment mettre cette \u00e9galit\u00e9 en place ?<\/strong><\/em><\/p>\n<p>Il y a fort \u00e0 parier que la m\u00e9thode n\u2019a pas \u00e9t\u00e9 ad\u00e9quate ou qu\u2019il n\u2019y a pas eu de r\u00e9elles volont\u00e9s de faire l\u2019exercice de comparaison. Ou comme le soulignait d\u00e9j\u00e0 en 2008 le Bureau International du Travail (BIT) <em>\u00ab\u00a0les difficult\u00e9s d\u2019application de la convention dans la l\u00e9gislation comme dans la pratique r\u00e9sultent surtout du fait que la port\u00e9e et les incidences du concept de \u00ab travail de valeur \u00e9gale \u00bb sont mal comprises. Pourtant, ce concept est la pierre angulaire de la convention. Il est au c\u0153ur m\u00eame du droit fondamental des hommes et des femmes \u00e0 l\u2019\u00e9quit\u00e9 salariale pour un travail de valeur \u00e9gale, au c\u0153ur m\u00eame de la promotion de l\u2019\u00e9galit\u00e9\u00a0\u00bb.<\/em><\/p>\n<p>Car il faut mener un v\u00e9ritable travail en profondeur pour d\u00e9terminer une valeur intrins\u00e8que du travail, reposant sur les exigences en comp\u00e9tences, efforts et responsabilit\u00e9s. Le BIT a d\u2019ailleurs d\u00e9fini une m\u00e9thode analytique par points et par crit\u00e8res et qui a \u00e9t\u00e9 appliqu\u00e9e par certains pays comme la Su\u00e8de ou la Finlande.<\/p>\n<p>Dans ces pays, un mod\u00e8le proactif rend obligatoire la mise en \u0153uvre de l\u2019\u00e9quit\u00e9 salariale dans les entreprises publiques et priv\u00e9es. G\u00e9n\u00e9ralement les caract\u00e9ristiques de ce mod\u00e8le sont les suivantes :<em> \u00ab\u00a0il s\u2019applique \u00e0 tous les employeurs r\u00e9pondant \u00e0 certains crit\u00e8res ; il impose des obligations de r\u00e9sultats, dans un d\u00e9lai pr\u00e9cis; il indique les principaux crit\u00e8res m\u00e9thodologiques \u00e0 observer pour atteindre ces r\u00e9sultats et il est r\u00e9alis\u00e9 conjointement entre l\u2019employeur et les repr\u00e9sentants des salari\u00e9s\u00a0\u00bb<\/em> (Promouvoir l\u2019\u00e9quit\u00e9 salariale au moyen de l\u2019\u00e9valuation non sexiste des emplois : guide de mise en \u0153uvre. BIT. 2008).<\/p>\n<p>Il y a eu d\u2019\u00e9normes d\u00e9bats sur la m\u00e9thode pr\u00e9cise \u00e0 adopter ainsi que sur les risques li\u00e9s \u00e0 l\u2019application de cette m\u00e9thode. Mais \u00e0 force de tergiverser le vrai travail de refonte n\u2019a pas \u00e9t\u00e9 fait.<\/p>\n<p><em><strong>Oser mener la r\u00e9flexion<\/strong><\/em><\/p>\n<p>La question des m\u00e9tiers indispensables qui a \u00e9t\u00e9 mise en avant durant la crise du Covid-19 ne devrait-elle pas inciter la Belgique et les autres nations, \u00e0 suivre l\u2019exemple du Qu\u00e9bec ou de la Su\u00e8de et \u00e0 mener un vrai travail pour arriver enfin \u00e0 une r\u00e9duction des \u00e9carts de r\u00e9mun\u00e9rations? M\u00eame si cet outil n\u2019est pas parfait, il pourrait en l\u2019occurrence poser le d\u00e9bat de fond sur l\u2019impact sur les salaires d\u2019une f\u00e9minisation de certaines fonctions qui sont pourtant apparues comme fondamentales durant la crise que nous venons de traverser.<\/p>\n<p>Cela demandera un effort collectif et aussi une refonte du budget pour une meilleure allocation des ressources. Il faudra accepter d\u2019augmenter sensiblement la r\u00e9mun\u00e9ration de certaines fonctions, ce qui pourrait entrainer des sacrifices pour d\u2019autres (comme par exemple le gel des salaires de la fonction publique appliqu\u00e9 par le Qu\u00e9bec).
