Les organisations syndicales en front commun s&rsquo;opposent actuellement aux propositions de mise en oeuvre \u00e9dict\u00e9es par le gouvernement et soutenues par les employeurs.<!--more--><\/h1>\n<p>La CSC, la FGTB et la CGSLB ont donc remis un avis n\u00e9gatif sur les propositions du gouvernement concernant la disponibilit\u00e9. <em>\u00ab\u00a0Trop de questions demeurent sans r\u00e9ponse sur le principe m\u00eame de la disponibilit\u00e9 adapt\u00e9e. L\u2019autre proposition, portant sur la disponibilit\u00e9 accrue des ch\u00f4meurs \u00e0 temps partiel involontaire b\u00e9n\u00e9ficiant d\u2019une allocation de garantie de revenu, est tout aussi inacceptable pour la CSC, la FGTB et la CGSLB. Les trois syndicats regrettent que les employeurs ne veuillent pas se rallier \u00e0 leur avis. Ce faisant, ils renient carr\u00e9ment l\u2019accord sur la disponibilit\u00e9 auquel ils avaient souscrit.\u00a0\u00bb<\/em><\/p>\n<p>Selon les organisations repr\u00e9sentatives des travailleurs, <em>\u00ab\u00a0les employeurs reviennent sur l\u2019accord sur la disponibilit\u00e9 auquel ils avaient souscrit. Le gouvernement a d\u00e9voil\u00e9 une premi\u00e8re proposition concernant la disponibilit\u00e9 adapt\u00e9e le 18 juin dernier. Cette notion est apparue en r\u00e9action \u00e0 l\u2019accord social conclu au sein du Groupe des 10. Les services r\u00e9gionaux de l\u2019emploi doivent dor\u00e9navant proposer, dans un d\u00e9lai de neuf mois, un plan d\u2019action individualis\u00e9 (formation, accompagnement \u00e0 la recherche d\u2019emploi ou toute autre mesure qui augmente l\u2019employabilit\u00e9 sur le march\u00e9 du travail). Un an apr\u00e8s son d\u00e9but, le plan d\u2019action est \u00e9valu\u00e9. Ceux qui n\u2019y ont pas collabor\u00e9 positivement seront sanctionn\u00e9s. Cette disponibilit\u00e9 adapt\u00e9e diff\u00e8re de ce qui avait \u00e9t\u00e9 convenu entre partenaires sociaux.\u00a0\u00bb<\/em><\/p>\n<p>Le front commun regrette les incertitudes qui demeurent autour de la d\u00e9finition de la disponibilit\u00e9: <em>\u00ab\u00a0ses conditions d\u2019application restent floues et ouvrent la porte \u00e0 de multiples interpr\u00e9tations. O\u00f9 se situe la limite entre la disponibilit\u00e9 active et passive ? Comment la disponibilit\u00e9 adapt\u00e9e sera-t-elle contr\u00f4l\u00e9e ? Qu\u2019adviendra-t-il de l\u2019accompagnement des RCC et des ch\u00f4meurs \u00e2g\u00e9s? Chaque R\u00e9gion peut, de plus, envisager la disponibilit\u00e9 adapt\u00e9e \u00e0 sa mani\u00e8re. Cela entra\u00eenera des situations inextricables dans les entreprises dont les travailleurs viennent de r\u00e9gions diff\u00e9rentes ou qui ont un si\u00e8ge dans plusieurs R\u00e9gions. Les services r\u00e9gionaux pour l\u2019emploi pourront-ils, par ailleurs, garantir \u00e0 chaque personne l\u2019accompagnement ad\u00e9quat ?\u00a0\u00bb<\/em><\/p>\n<p>Parmi les incertitudes et formes de r\u00e9gression identifi\u00e9es par le front commun, citons les AGR et les RCC.<br \/>\n<em>\u00ab\u00a0Pr\u00e8s de 50.000 personnes sont actuellement au ch\u00f4mage involontaire et touchent une allocation de garantie de revenu (AGR) vers\u00e9e par l\u2019ONEM en plus de leur salaire de travailleur \u00e0 temps partiel. L\u2019AGR a \u00e9t\u00e9 con\u00e7ue, \u00e0 l\u2019origine, pour \u00e9viter le pi\u00e8ge du ch\u00f4mage et promouvoir l\u2019emploi.<\/em><br \/>\n<em> La d\u00e9claration gouvernementale d\u2019octobre 2014 pr\u00e9voit de supprimer une part importante de l\u2019AGR aux travailleurs \u00e0 temps partiel qui en b\u00e9n\u00e9ficient. Pour commencer, depuis le mois de janvier, l\u2019AGR est \u00e0 nouveau calcul\u00e9e comme avant 2008, ce qui revient \u00e0 la diminuer. Ensuite, le gouvernement veut r\u00e9duire l\u2019AGR de 50 % apr\u00e8s 2 ans.<\/em><br \/>\n<em> Les femmes sont particuli\u00e8rement affect\u00e9es par cette mesure parce qu\u2019elles sont tr\u00e8s nombreuses \u00e0 travailler dans l\u2019horeca, le nettoyage et la distribution, des secteurs o\u00f9 les r\u00e9mun\u00e9rations sont d\u00e9j\u00e0 peu \u00e9lev\u00e9es et o\u00f9 les emplois \u00e0 temps plein sont rares. Le gouvernement veut maintenant que les travailleurs \u00e0 temps partiel avec AGR recherchent activement un emploi \u00e0 temps plein et contr\u00f4lera s\u2019ils le font. Ces travailleurs seront donc incit\u00e9s \u00e0 combiner un emploi \u00e0 temps partiel souvent tr\u00e8s flexible avec (la recherche d&rsquo;un deuxi\u00e8me contrat de travail.\u00a0\u00bb<\/em><\/p>\n<p>D&rsquo;autre part, <em>\u00ab\u00a0les travailleurs qui auraient pu partir en RCC, mais qui avaient pr\u00e9f\u00e9r\u00e9 continuer \u00e0 travailler \u2013 souvent \u00e0 la demande de l\u2019employeur- moyennent la garantie de leurs droits selon un syst\u00e8me de cliquet, auraient d\u00fb \u00eatre dispens\u00e9s de disponibilit\u00e9. Mais nous constatons aujourd\u2019hui que la r\u00e9glementation les contraints \u00e0 rester disponibles jusqu\u2019\u00e0 leurs 65 ans (sauf si 43 ans de carri\u00e8re).
